Crap, I should not have taken an interest in this thread. We had our first trespasser yesterday. We are in the process of building a barn for the horses. Someone that knows someone my wife sort of knows came to check it out. Drove right in our driveway, past the house and to the construction site. I was not home. Wife went to investigate and had to throw them off the property.

Told the wife that was a poor choice. She should have gotten the pistol out of my night stand, stayed in the house and called the County PD.

Trespasser were lucky as I likely would have gone out to greet them with the pistol on my belt just not concealed.

If they had just stopped at the house and asked if they could see the barn we probably would have said yes.

You know - it would appear to be a common thread with those who would trespass. They must be just plain stupid - they come thru the gate with the NO TRESPASS sign, drive by your house to a remote location on your property and never think to stop at the house and introduce themselves or ask permission. I'm somewhat surprised that more of this type aren't shot. Then, many times, they have the gall to argue with the property owner.

I guess God must be protecting the ignorant & feeble minded.

You know - it would appear to be a common thread with those who would trespass. They must be just plain stupid - they come thru the gate with the NO TRESPASS sign, drive by your house to a remote location on your property and never think to stop at the house and introduce themselves or ask permission. Unfortunately as you can see from the earlier discussion many view the retaliation against these arrogant disrespectful trespassers negatively which is somewhat surprising.

Disabling a 4 wheeler turns into stranding a disabled vet who ends up dying so the person who disables the 4 wheeler is made into a murderer in the far fetched scenario that was brought up earlier. A person into far fetched scenarios could probably do the same thing with the burying the vehicle example that as used but fortunately that didn't happen.

The landowner who set off a paint bomb on a repeat trespasser and the judge let the trespasser off and charged the landowner was yet another example of reversed consequences.

In many cases it seems the retaliation receives worse punishment than the original trespasser who caused the whole problem in the first place. As a landowner it seems we have to play by the rules even when the other side isn't or we could end up in more trouble than them. But our society has some bizarre court rulings that confirm this to be the case. Proving the trespassing can be challenging as these people know how to use all the lies and excuses to justify thier trespassing bahvior. "We've hunted here for years" "I'm tracking a deer I shot on the neighbor's place" . Even confronting trespassers is likely to end up with the landowner in trouble at this point so even that is risky between getting hurt and getting in trouble.

But this is not just happening on hunting issues. Look at the squatters who somehow have rights in homes they do not own or have any permission being in. Landowner gets in trouble if he/she does anything to force them out.

It seems that our freedoms have come full circle and instead of allowing people to be free it allows people involved in illegal behavior more rights than they should be entitled to which only causes more of this behavior to happen. I've followed quite a few trespassing/poaching cases over the years and most of the time the punishment seems to be more of a slap on the wrist than justice.

If you really want to get into a soap opera of trespassing and poaching look into the State of Montana case against John Lewton and the record book ram. Up there you are talking auction tags that bring hundreds of thousands of dollars each. Yes people pay $300,000 to shoot a bighorn sheep. Guides who fly ares scouting animals year round including having stake out teams of 15+ monitoring an animal's every move during the season when they are guiding high $ hunters. Undercover agents going as far as shooting record book animals. Long drawn out court cases involving huge amounts of time and resources only to result in almost nothing. It's to the point of why wait for years or even decades to draw a premium tag when you can just poach and likely not get in much trouble if you get caught.

The issue with retaliation, and the point those of us are trying to make with these "what-ifs, disabled vet" scenerios is that there is always two sides to the story.

There could be a ton of legitimate reasons why someone is trespassing. And we could play these what-ifs all day long. Does it make it right to trespass..... NO. Should they be held accountable/punished/fined......absolutely. But as an individual/landowner....it dont give us the right to play judge-jury-executioner, and levy the punishment.

ITs a case where two wrongs DONT make a right. And slashing someones ATV tires for vengeance/spite/punishment is NOT a wise thing to do.

Again, there are some legitimate reasons, and we can play what-ifs all day long. The trespasser is 100% in the wrong, and should be held accountable. But it still dont give you the right to slash tires.

Bull, there is no legitimate reason to trespass holding a gun or riding a vehicle, you contact the owner if you have a real need to access the property. And this is what this thread is about hunter's that knowingly trespass. I have the utmost respect for vets and the disabled( have them both in my family) but they have no right to trespass.

In this day and age with GPS on every phone and handheld units under a hundred dollars, if you can afford to buy ammunition and a license you sure as heck can know who's land you are on.

Well, are we just talking trespassing in general? or are we talking about trespassing while holding a gun and hunting?

Again, I agree 100% that its wrong and the trespasser SHOULD be held accountable. Where we differ on opinion is how we handle the situation. Vengeance/retaliation is NOT the answer IMO.

As far as legitimate reasons, again I can play what ifs, but what if someones dog got out? Horse got loose? Cows broke through a fence? And the owner is trying to heard them as quickly as possible before they get any further away? By the time you talk to the neighbor and get permission, they are already on the next property....so on and so forth. Animals dont follow property lines. When you are chasing a loose animal, you have no idea where they are gonna go and whos property they will cross over or end up on. All you are concerned about is getting them home safe.

So in the haste of the moment.....yea.....if find that a legitimate reason. Still wrong....yes. But does that justify slashing someones tires over?

When you stumble upon a seemingly abandoned ATV, and want to jump to the conclusion that they are illegally hunting/poaching and want to act hasty....consider the possibilities. While 99% of the time you would probably be right. There is always that what-if.

Again....always 2 sides to every story.......and no matter what the reasons.....2 wrongs will never make a right
