No where in the US does criminal trespassing bring the death penalty. Not at 1600 Pennsylvania Ave., not in MO, no where. Shirley there would be repercussions for the person that disabled the vehicle if it were proven a death was the result.

I own 76 acres on top of a mountain in western Md. almost surrounded by state game lands but the game lands are hard to access without using my property. I have trespassers all the time. I had one particular clown standing in my personal tree stand in my orchard. I asked him who he was. He said none of my business. I asked him if that was his tree stand? Again, none of my business. I then asked him who gave him permission to hunt the property he said "the guy that owns that **** house in the other field that's who !" Well,, he was really hoping that wasn't my house...

I also have collected multiple tree stands from my property. I usually leave a note with my phone number and I do give them back to them after the embarrassment of them having to come to my house and retrieve them.
I usually don't have a problem with people retrieving a deer on my property. That is mostly not to just be kind but because that is the ethical thing to do.

What I like are the hunters who trespass 40' to 50' over a barbed wire fence, find a suitable tree for their climber, and proceed to groom the area for an open shot. Always love to see the saplings cut off at waist level. I'd love to catch them up there some time.

Well I think you just missed my point. I'm saying if the old guy were on that quad, would you still shoot him for being there on a quad. Maybe a vet.. apparently doesn't matter to you?

If you shoot the quad of a guy that old that far into the wilderness you just killed him.

I don't mean any offense here I just picture my 75 year old dad who calls his quad his legs because he spent 40 years on a factory floor and his feet are shot. If he were even 5 miles in would probably not make it out without his quad.

You are the one missing the point here and trying to find something to be upset about. Nobody mentioned shooting another person which is what you keep repeating.

It is illegal to drive a 4 wheeler in wilderness no matter the situation, age, background, disability, etc... which you seem to keep bringing up. Even illegal for your dad.

Wilderness is not for motorized travel. There are plenty of places to go ride a 4 wheeler legally so non need to go places where it is illegal.

How much wilderness do you have in Ohio?

Square 1 - unfortunately, your statement regarding criminal trespass is probably now true. When I was first in Alaska( '59 thru '65) trespass fell under the same law as - breaking/entering into a house with the intent to do bodily harm. And YES, it was not against the law to shoot a trespasser. Experience from neighbor who had his two sons shot when entering a homesteaders 360 acre homestead. The homesteader was only questioned and NEVER charged with anything. Right or wrong - it was the law of the land at the time. Those were the good times - but like so many other places - they are simply a memory now.

Who the heck is Shirley?????? Did you mean surely???? Does that mean you wish and hope there would be consequences? Be very hard case to prove. Bullet would most likely be too deformed after striking the engine/tranny to get ballistic firearm data needed for prosecution. They then would have to prove you were in the woods at that time at that place. Not impossible, but unlikely with anyone who knows anything about woodcraft. And mostly, I can not believe you, This was a "what if" liberal "save the criminals" dream scenario.

So a old man illegally drives his 4 wheeler miles into a wilderness only to have another hunter disable the 4 wheeler which results in the trespasser having to walk out. Then in your twisted mind the person who disabled the vehicle should be the one in trouble not the person who trespassed in the first place. LOL. That is some back East thinking right there.

On the 65 acres we have found two deer stands and removed them... no idea who put them up.

A few months back I counted 22 deer down in the hollow... most I have ever seen... maybe because my brother doesn't allow hunting they feel safe? Also lots of wild turkey... several have asked but he keeps horses and they don't like the sound of gunshots.

Mom has 4 or 5 that live on her property... it's in the city limits so no hunting.
