ANY dog that comes onto your property unatended you have every right to do whatever you wish to do to said animal (gee, wonder where the owner is).

My only point is that to many people catagorize "mix breeds" as pit bulls, period. To some extent, certain dogs, like guns, get a bad "rap" due to the people that own them.

Yeah, I see allot of minority groups in town that have a Jack Russellls (sp?) To some, its a status symbol (sp?), period. Great reason to own a dog.

ANY dog bred sp? for fighting, sad to say, should be put down. I say sad because it's the training "learned" by the dog from it's owners. ANY dog that shows agressive behavior should be watched and cared for in a protective manner by the owner.

Yes, after reading the first post, Buster was left unleashed, I'm guessing off of Busters owners property. Great owner Buster had. If by chance Buster was on the "pit bulls" owners property, I would call it even. Sounds like two idiot dog owners.

I'm surprised that AFTER the first attack mentioned by the "pit bull" that the dog was still alive after that incident.

I'm with the others that the dog owner is going to pay on this one.

Debbie rescued a mutt (lab mix), she was mostly friendly somewhat skitish would be more correct. As she became accustomed to us and treated well, she adopted us. That is when the problems started, she became incredibly protective, especially of Debbie. We spent nearly $1,000 on training socialization. She nearly bit several people, all of the dog trainers said she had to be put down simply due too liability. Known aggressive dog bites someone, chances are we would loose everything.

As Sigarms was eluding to it is not the breed but the dog. Or more correctly how the dog was treated by its people. We had a Chow/Shepard as long as you did not hurt Debbie, all he wanted was a treat and a belly rub.

When we moved into our house last month our neighbor with a pit spent ten minutes telling me what a good dog she is, and how she will stop barking at us when she gets used to us. He also casually mentioned that she has gotten out twice in the past year, and although she hasn't bitten anyone, she went off her property and cornered people each time.

Everyone on my street has at least one dog, many have two and I like to get along with my neighbors as much as possible. But, I let him know that if I caught that dog on my property I would put him down. I've got a 12 year old son and a dog myself and I don't need either of them being injured or killed because he has a mean dog with a history of aggression. I'd feel bad for killing the animal, but not as bad as I'd feel if my family was injured.

Since moving in my son has become good friends with his son. One day they were climbing the fence between the two houses into the neighbors back yard. The neighbor assured my son it would be okay to climb over. Well, the first leg was no more over the fence than the pit grabbed my son's shoe. My son knows now to stay out of the neighbors back yard.

We're in a good neighborhood in a small suburb, and my neighbors seem like a pretty nice family with four kids. Their other dog, an ancient German Shepherd, is sweet as can be. I don't think I can really blame the neighbor for the disposition of the dog, some dogs are just bad dogs, however, that doesn't abdicate his responsibility for it when he knows how aggressive his dog is.


I'm doing my part to stay a good neighbor by replacing the chain link fence between our properties with a privacy fence (he's picking up half the tab, I'm doing the install) which will hopefully let the neighborhood become not only a little quieter, but a little safer.

I'm certainly not an expert in these legal fields but I thought (here in CA at least) that the home sale couldn't be forced but that a judgement lien could be put on it so that any future sale would have the judgement amount directed to the victim.

Is my thinking incorrect? Or is it different in other states?

Just ask OJ - if your name is on the Deed then all is fair game - just petition the court to expedite payment once judgement is granted they start by seizing and selling assets -homes, cars included - all states would be fair game if the amount is not paid in a timely fashion

My neighbor had the dumbest looking dog you ever saw. It had no tail or hair, a huge mouth and his skin was yellow. The thing never barked either. One day a big pit bull known to be a good fighter got into the yard and that yellow dog tore him apart. I mean it was no contest. Dust, blood and fur flying everyware. The pit bull barley limped home and survived. I asked the neighbor what kind of a dog is that yellow dog. He said he wasn't sure but before he chopped of his tail and painted him yellow he was an alligator!

What I meant when I said the homeowner would lose their house was not that the victim would just take it and move in but it would most likely have to be liquidated to meet the finacial burden of the law suite.

As an owner of an American Staffshire Terrier (sp?), I find it more than funny how people "catagorize pit bulls".

Posts like this give the breed a bad name, it's not the dog, but the owner.

Yeah, my Sig is really a bad gun.

I'm %100 sure it was a pitbull. It is a pure breed. I'm not against pitbulls but this one was a terror since he got hit. As I mentioned it already attacked his other neighbors dog that was tied in its yard AND the owner of that dog. No, I have no idea why it was not taken care of after this first incident.

The pitbulls owner lives about 20 ft. beside the auto body garage that Busters owner owns. Buster was in front of thebody shops garage door standing in the road. ( it is a rural area, not much vehicle traffic if any at all)
The pitbull is always pushing on it screen door and barking like crazy at anything and anybody he can see through the screen. It just so happened that when he pushed on the door to get at Buster the door was not latched all the way and he got out, again. Buster was in no way on the pitbulls owners property.
BTW, I seen Buster today and he is pretty much as good as new, All the hair around his neck is shaved and the stitches and staples are still there though. But he was still able to jump up in my truck when I left the door open and take a nap on my seat !!

I agree with this completely. Liability is not decided by a vote of the community. It is decided according to law, and I think the pitbull owner is wrong, and is liable.

Talk to an attorney, soon. I don't care about friendship here, the pitbull was a danger, and if it replaced with another one the new one will shortly be a danger too.

Buster's owner may see one of his friends or customers injured next...

If Buster was not on the property of the pit bull owner, yes, the pit bull owner should take care of the medical bill.

That being said, Preston county has pretty much the same folk as Garrett county (other than the relocated tourists around Deep Creek), and somehow I just don't see these guys getting a lawyer involved.
