That being said, Preston county has pretty much the same folk as Garrett county (other than the relocated tourists around Deep Creek), and somehow I just don't see these guys getting a lawyer involved.


Once again Sig, You have the people in this area nailed. He just paid the $1200 and let it go. I guess he thought the guy lost his dog and that should be payment enough. Not if I was in his shoes but.......

How long before the person gets another dog, and we read about this all over again?

Sometimes you have to make an example of some people. They don't understand it is called - accountability, and a lot forget that word should be part of their lives.

The pitbulls owner lives about 20 ft. beside the auto body garage that Busters owner owns. Buster was in front of thebody shops garage door standing in the road. ( it is a rural area, not much vehicle traffic if any at all)

I agree with what every one is saying,the guy should be liable,but this could be a weak link a defense lawyer would use.If the dog was in the public road,[buster] then it was not where it was suppose to be either...technically if you have a dog leash law,or running at large law in your state.So,you got two dogs running loose that fight in a public road,is this correct?Then busters owner gets bit,trying to break it up?Please keep us posted,i would be interested in seeing how this ends up.
Just trying to see another side guys,even though i wouldnt agree with it.

I would have to agree with you that a good lawyer would probably get the dog injuries to be a wash considering that they were both uncontrolled on public ground. That leaves us with a Pitbull that injured a person on public ground. Thats a BIG NO NO. Dogs can't file suite against people and vice versa anyway so it would always come down to human vs. human. The human who gets injured walking down a public street will have the overwelming advantage in court.

Talk to an attorney, soon. I don't care about friendship here, the pitbull was a danger, and if it replaced with another one the new one will shortly be a danger too.

Actually, liability is decided by a vote of the community, in the jury box. In some states, like mine, dog ownership creates STRICT liability. If you own the dog, you are liable for its actions, no excuses, no mitigation. The original poster needs to file a claim on the owner's homeowner's insurance. If the guy won't file the claim, see a lawyer. He may end up with a lawyer anyways, but its worth a shot directly with the carrier first. Don't give away 1/3 of your money unless you have to. Believe me, an attorney won't usually get 1/3 more than an intelligent and educated person can get themselves, if its a decent carrier.

A friend of mine used to own a Chow, and that was the meanest dog I've ever seen. He had to kill it because it got loose and tried to kill one of his neighbors German Shepherds. Another friend has a Pit, and it is one of the friendliest, most docile animals I have ever seen. Dogs are like kids, it depends on how they're brought up.

Scesnick, have to remember, I was about as "local as you could get" living in the only trailer in town just down from you in Preston county. Although I'm not from that area in general, and now in N.C, and although my wife and FIL are native Vermonters, my wifes grandparents are from Oakland and Tarra Alta, and still have family there.

Good, simple people (not meant in a derogatory sp? way). Lawyers, from what I've observed, are not a part of the equation in most peoples lives there.

Would like to retire back up there someday, only afraid that all of those people from D.C and Baltimore are going to ruin the area and drive land prices through the roof.

Development, it's going to happen for better or worse.

I agree that environment has alot to do with personality but only to a point. I also think that some animals have been bred to behave in a particular manner just like some are bred to look or perform a certain way. So I guess what I believe is there are some breeds that are more aggressive than others.Most of the bad behavior can be trained out of them but without constant attention to it, may come back in time or in certain circumstances.
