Once again DJ you are correct.

Tonight I started her up let her run for a half hour and got everything all warmed up. Got the wheels up in the air and started going through the gears and forward / reverse nice and slow with no issues. once I was confident, I pressed on the brake…the tires stopped…I let off on the brake…pressed the throttle…and nothing…I put my foot under the brake pedal…lifted up…and the tires started moving again…did this two or three times just so my cro-magnon brain got it all, and was convinced…that clutch cut out switch is being made...Now it could be the cold…the linkage…a spring…the adjustment on the brakes I did, or some combination of all of that..I'm going to take the service manual in to work tomorrow, and the maintenance engineer said he would look at it for me…I'm pretty sure it's not the tranny….thanks DJ again...

I took a few minutes, and looked through the parts book. I don't see a clutch cut out on the B's system. So, possibly the C series, like mine were the first to have it.

That being said, and you saying you need to take your foot, and pull back on the brake pedals has me thinking maybe things may just need some lube. That, or the return springs may be broke, or just weak. Being you adjusted up the brakes, maybe they are working good enough to stop wheel turn at slow engine RPM's, and you're over powering them when throttling up. Pulling up on the brake pedals fully releasing the brakes, lets the torque converter turn things a lot easier.

If you go back to that link for the parts pages, open the link for the brake pedals & linkages. Note the zerks at the top of the pedals where they pivot on the cross brake shaft, up under the dash. Then the lower cross shaft, there are also a couple fittings, where the entire shaft pivots on the end, plus the pivot levers on the pivot stub ends. I'm thinking this is all under the front floor pan. Then you've got all the pins & yokes in the linkage... Betting they could all use a little shot of some sort of lubricant. Maybe some penetrant to get them loosened if frozen, then follow up with some sort of machine oil. It may possibly list in the service manual what to use on them.

If you had the front floor pan off for the repairs just made, it may be easier to gain access to the linkages that way, instead of from underneath. Mechanics choice on that one I guess... Might want to check the parking brake cable also, if it is still functional, and see that it isn't partially frozen up, keeping the brakes from fully releasing too.

Ok if you compare the photo to the illustration you can see that my return spring is basically shot..I'm going to order a new one

That appears to be the clutch return spring, unless you mean it's not making the clutch pedal mechanism return fully right away..?? ( Does that even make sense..?? LOL) But yeah, looks like it's seen it's better days at the lower hook.

I was thinking more like the brake's not fully releasing, unless you pull up on the pedals causing your problem. If that is the case, and problem, then the springs you're looking for should be back on the second pivot/rock shaft. #'s 50, in this exploded view. Official Case Construction Equipment Online Parts Store and Parts Look Up. Parts for Case Equipment and Construction Equipment. Parts Store for Case Wheel Loaders, Case Excavators, Case Skid Steers, Case Original Parts. (Hope it loads..) So each pedal has a return spring of it's own.

I'm still thinking lack of lube on the pivot points, although the springs may be weak, or even missing. And I only say this, because of the crud & dirt I found under the floor boards of mine. That, and lack of easy access to lube those points.

If I misunderstood what you meant posting this, please excuse...

I was referring to the clutch return spring. First of all I don't think that's the original one...Second I believe the mounting bracket is upside down because the spring is too long. It also has no spring left in the spring...lol

Gotcha'... So did you get the brake pedals & linkage's, to where the pedals fully return on their own..??

no not yet...I know i need to do a complete brake job on the machine. I'm going to be spending some time on her and take care of that soon. Going is important...stopping is optional...less important...lol

You always got the big brake hanging on the front, in case of emergency..!! LOL...
