Sounds like a plan but I'd have to wait until it freezes solid then excavate the "water".

Be careful what you wish for. If you say he has no rights on your side and he agrees, that means you have no rights on his side either. He may just go ahead and dig up his side of the dam and let all the water out to spite you.

Actully, that wouldn't be a bad idea. If he would dig up the 10 feet dam on his property, he would be giving away any pond rights he had. I could then rebuild the dam 100% on my property. Expensive, but very doable.

Then just remove your dam, drain the water and rebuild the dam on your side. Seems like a lot of time and expense VS just getting along. /forums/images/graemlins/crazy.gif

I believe that if I initiate that, I would have to get permits and his approval for excavating on the property line. He also has rights to the 4% of the water that is on his property. I wouldn't mind if he did it but he sure would mind if I did.
As an aside, I think we have an amicable solution, I let him fish over the property line, just no boat. I don't plan on changing that unless he takes me to court. We had a nice 45 minute chat the other day and everything seems to be quite now. We just both think we're right and his boat is still there. I believe that the fish over the line is a good compromise given the Nottilini decision.

So what is the big deal of having a second pipe if it is done corectly (I would think a spillway would be better)
And why is him fishing where he thinks the fish are a big deal you running around naked or something?

I attached two images. One shows where the boat was while I was having a family cook out and the other shows what happened when he put hay bales on his property, we got a 150 year rain and they plugged up the drain. I made the images small to post but they give the general idea. I probably would not have been so put out if he just had asked first.
