TC33DA delivered .... but ... is this normal?

My new TC33DA was delivered today. I feel I should get better treatment from a dealer than this /forums/images/graemlins/mad.gif. Let me know what you think of all this (is this normal?).

1) ordered 60" NH 105A tiller, went over this many times, and even before delivery. I have written quote that says 60". Was delivered with 48" tiller.

2) I OK'd order and got credit approval 2-3 weeks ago for the specific TC33DA tractor I ordered. At that time the tractor had 0.7 hours on it. It was delivered today (same tractor) with 11 hours on it. And (see next) this worries me because it may have been overheated. I bought a new tractor so I would know *exactly* what its history was. Is that OK to demo or rent a tractor that is already bought?

3) Was delivered with about 1/2 empty radiator (really, I couldn't believe it). So now I figure everything is suspect and I need to go over the setup checklist before I even start it.

4) Am still waiting for the grille guard even though it was ordered over 2 weeks ago.

5) Also am still waiting for the rotary mower that was ordered over 2 weeks ago.

6) Delivery guy just dropped it off, took my check, and left. I had to look in the manual to figure out how to start it.

This should be a happy day. But now I have a tractor without a tiller or mower and with 11 of someone else's hours on it and an empty radiator. /forums/images/graemlins/frown.gif

Personally I would be very upset. My NH dealer gave me the once over outside, then sat at the kitchen table with me and went over the whole manual, then went back outside and gave me a detailed tour of the tractor.

My Ventrac was delievered a month ago and and pretty much did the same thing except he was there to give me a demo and I ended up buying it on the spot so it was a little different but still very complete.

I'd be calling the salesman first thing in the morning and reading him the riot act and threaten to have him pick up the tractor unless he gives you a free oil change in exchange for the 11 hours, I'd also demand he send someone out to top off the radiator and run though through all the operation of the machine.

Hey Mr. dealer, you made a mistake and brought me someone elses rig buy mistake. /forums/images/graemlins/shocked.gif Im the guy who paid new price for a new tractor. /forums/images/graemlins/cool.gif /forums/images/graemlins/grin.gif I would not accept that unit. I dont know about any one else but i recieved the exact rig i kicked the tires on at the dealer. them jokers would be standing around the water cooler wondering where I did buy from. /forums/images/graemlins/mad.gif

So, I'm not over-reacting here? I mean 11 hours is not that much. But with the half empty radiator, it really is possible to do some damage to the engine isn't it?

I am very particular about the overheating, because my last tractor (JD 755) was used and turned out to have a blown head gasket from overheating. And thats why I bought a new tractor.

I'm not sure, but I believe federal law allows you a three-day grace period in which you can refuse the product and the credit. If the dealer wasn't willing to take the tractor back, I'd exercise that option. It's your right to have a new tractor delivered. Signing for it was a mistake, but I think you still have a window of opportunity if you act.

I'd call him and tell him I wanted a new tractor and not give an inch, maybe even follow up with a registered letter and a telegram. This is a clear case of "bait and switch" in my book.

I went back and read your post and you didn't say you signed for the delivery. You only said you gave the delivery guy a check. That gives you additional strategy because you can get the check stopped if necessary.

I think you have to force yourself to be calm and methodical, but not lose sight of the fact that you did not get what you signed a contract for. Your dealer has no good reason for putting 10 hours (like 500 miles on a car) on your tractor without discussing this with you. Wouldn't your dealer be upset if you showed up driving a tractor you had taken off his lot and used over-night without his permission? Once you signed that credit contract it was his duty to protect that product. He didn't do that.

First off, you should have refused delivery.
I would call and demand that the tractor be picked up and your check returned. At that point, your free to either deal with them again or go elsewhere. G

I'd be very, very upset. You were ripped off. Like others have stated act FAST, demand your money back in full or another tractor with proper delivery and training, and finally, document, document, document and threaten with reporting them to the attorney general of your state if all else fails. Good luck, we're with you.

I agree with the rest, 11 hours is a demo unit and should be discounted as such. I would not let them bully me into taking it by saying that you signed for it, you can counter that with I was not delivered what I was promised, I did sign for what you delivered, but this is not what I bought.

I would not put any time on the machine so they have no way of implying that you caused any dammage. I would also call the district rep and log a complaint, be accurate, and do not accuse, slander or in anyway exaggerate the situation as there is no need, it will only hurt your case.

Demand that they remove this demostrator unit from your facility and bring you the new one that you ordered with the correct equipment or bring your check back.

I may be in the minority here, but. Before you go off half cocked, why don't you ask your dealer about the hours. He may have a good reason for them.

The 11 hrs. aint the end of the world even to me and im picky fer sure. But its clear the unit was not even checked out before delivery to you.Not a good sign to me.Shame on the dealer for not careing enough to prep this unit before delivery. Makes you wonder if it was preped before he lent or rented it out to whoever ta put 11 hrs on it.Couda been some knot head who didn't know your suppose ta take it outa 4x4 before he drove 37 miles to aunt gurdies house!
