I know you guys are correct - in greeting folks with a loaded gun. That's why the discussion with local LEO before you do something- anything- as I stated.

Interesting fact - I lived in AK for 20+ years and the laws there, regarding this, were truly "wild west". You had to be careful as you traveled around because up there trespassing was considered the same as breaking & entering into somebody's house with the intent to do physical harm.

A person was allowed to defend his property with the use of deadly force. This could have changed now - I was there in the early '60's & '70's. Thing may be "all civilized" now.

Not sure what you mean by "greet" but in some states you'd be in big trouble if you actually pointed (banishing a weapon) the gun at a trespasser. Fine line between what is permitted and what is illegal. Laws vary by state.
My question is for Ed of all trades also.

I see some problems with this. The laws and those making the laws benefit the criminal, and what if you walk up to someone on your property with a gun in a holster on your side clearly visible? Is that considered brandishing? What oosik is doing IMHO is not brandishing. Having a gun not visible, then in a confrontation making it visible is brandishing a weapon. Is my thinking wrong?

In Va showing up with a gun is brandishing a firearm, 6 mounts jail time, point it at them and it is assault, I don't know how long and don't want to know.

Here in Ohio the Trespasser would be charged with criminal trespassing.

So someone with a holstered sidearm or a rifle in a sling on there own rural property with stranger approaching could be charged with brandishing a weapon???

It must be different in Durango AZ because just about every cowpoke had a sidearm... walking down the street.

In WA my property is in a no firearm discharge zone... my neighbors are not... so anyone hunting would have a big problem.

In California my property is also in a no firearm discharge zone... although, neighbors have applied and received Fish and Game permits for mountain lions killing stock... and this is in the city limits a few years back.

Many people won't take a sign seriously if it looks like it was meant to be clever/funny.

A friend just had a "home invasion" of sorts. They live on a dirt road in a very rural area. Their house is about 500 ft. from the road. His wife and two children got home late one night and there was someone in the house. They called the police and it turned out to be a drunk sleeping on their couch.

So we've been looking into options for a gate. There are some really nice gate openers that can be attached to a deep-cycle battery and a solar charger so that the whole system doesn't need any trenching/cables. We figure we can do the whole job pretty cheap with a big tube gate from TS.

It's insane to think I would need a permit from the Fish and Game to protect my livestock.
I'm not trying to pick a fight over your comment. I sure don't like where all this gun control and government control in general is going.

"Private property. Cameras on premises" gets the message across. My mom would still give me a smackdown if she saw signs like those you guys suggested. My dad is a grump (especially when he watches Fox news) he would think those signs are alright. It's new world we're getting into, wonder how rude the kids are gonna be when I'm old. :eek:

I'm not a lawyer so this is only my opinion. Don't know if your thinking is wrong or not. As I said, laws vary widely by state and circumstances. Indiana law doesn't even use the term "brandishing". It only deals with pointing a firearm. Unless you are "justified" (a complex issue), then pointing a loaded firearm is a felony, unloaded is a misdemeanor.

Indiana Code - Section 35-47-4-3:
(a) This section does not apply to a law enforcement officer who is acting within the scope of the law enforcement officer's official duties or to a person who is justified in using reasonable force against another person under:
(1) IC 35-41-3-2; or
(2) IC 35-41-3-3.
(b) A person who knowingly or intentionally points a firearm at another person commits a Class D felony. However, the offense is a Class A misdemeanor if the firearm was not loaded.
