I read Virginia law on brandishing. Brandishing is showing or pointing to a fire arm with INTENT TO THREATEN. Carrying is ok. Putting your hand on the gun in a threatening manner is a no no. Pointing a gun at someone is assault and is a felony. It's all subjective as far as brandishing. I think this law can be used(abused) to give gun carriers a hard time. Even if the Govt. can't prove it's case, you can go broke defending, which will deter carrying.
This goes back to the gun rule " Don't pull it out unless you plan on using it." Several years ago a mother took a gun to a bus stop around here. She was arrested for brandishing. But there was several different stories about what took place.

There was a study done of the most effective signs for deterring trespassers or burglars. Turned out, the best was "Watch the Snake."

Of course this only works for those on foot.

Our land is nearly surrounded by state game lands and hunters start there but wander over to ours. We have plenty so its really not a problem plus I don't want to run around during hunting season playing the role of cop. Plus the more deer taken the better. We allow walk-in fishing and thus get a generous amount of stocked trout. But two problems: one is that just when you want to fish there is someone already there. Second is that fisherman tend to leave litter. Its funny, a hunter can move through your land and leave little trace but people who fish leave bait packaging, food wrappers, bottles, and lots of line. Don't know why its so hard for them to just carry it out.
Sort of off-topic but have you thought of leasing your land to a hunt club?
In Mississippi they tend to pay a little more than your taxes per acre but they also "patrol" a bit and are essentially an armed force that pays you for the right to protect your land.

I've seen ads for this and considered it lightly. But the idea that they pay to protect the land is an interesting way of looking at it. Might take a few steps to look into it further. I should ask if any of the members here have experience with this -- in a new thread. There's pretty much nothing that someone doesn't know something about. :) Thanks for the thought.

A very good case could be made by any first year lawyer that the mere moving you coat to the side to show another you are armed is brandishing. Any suggestive moves or looks at a rifle one is caring could also be brandishing. For example: I could testify that when when I told him to get off my land he said, "I don't think you know who you are talking to", as he glanced at the rife's safety and tightened his grip.

Jack707,

I know the feeling. We live on a private road that has access to a large lake. Come spring every country boy in the county finds his way down. We used to lock a gate but with full time residence now, no one wants to get out in the rain/snow to unlock/lock the gate.

I think a gate left open with a sign that states: Call the Sheriff in case you get locked in. This would be next to the NO TRESPASSING sign. Oh, and have a nice day :)

That's why you put an electric gate opener on it. Our gate is closed about 99% of the time, whether we are here or not. Only left open if I know in advance someone is coming to visit, or expecting a package.

This is what I did to solve a similar problem on my .5 mi drive. It might be overkill, but since the install we have had maybe 1 turn around in a few years (used to be a couple a day). It is all automatic so it is closed nights, weekends and holidays and open during the day. Even open people don't drive through. There is a keypad for entry and ups, FedEx, etc have codes. We have a call button on the box too. There are transponders on our cars so it opens for us and an auto exit loop

(Posting the pic isn't working so here is the thread, pics are on the last page). http://www.tractorbynet.com/forums/projects/290381-driveway-gate-how-questions-challenge-2.html
