Here it goes by GVWR, reg. weight or actual weight whatever is higher.
When running interstate it goes by GVWR.

You may not need a cdl, but you definitely would need a health card over 10k lb combined gvw if its truck trailer combo. DOT will swarm all over that one. Ask me how I know.

Not necessarily for intrastate use in NC.
That would be the case in FL according to this.
