The road may be on your property but you have given away some rights to the neighbor. I recently read a thread here where a guy tried to restrict access to his neighbors rightful access to *his* land. He tried to get the guy to slow down and restrict his right to upgrade and maintain the access. He installed speed bumps and?? In the end the land owner lost in court and had to pay +/-$500,000 for basically trying to restrict the neighbors use of *his* property. The neighbor claimed the speed bumps caused him to lose stuff out of the back of his truck and that he was harassed. It seems the legal system agreed.

What is the speed limit on *your* land? You may not be able to set it at what you want. The neighbor has rights to your land. You gave them to him or you bought property with the rights already ceded.

Speed bumps slow emergency response time and can damage vehicles. I believe responders estimate 30 seconds delay per speed bump. The neighbor has a right to access and may be entitled to damages if the access is limited.

Just some things to think about. You may want to check with a lawyer...not that it helped the other owner. The guy that lost 500K had a LOT of support for his position in the long saga but ended up losing a LOT for basically trying to restrict his neighbors rightful access to *his* property.

I bought the property with the road easment in place. From what I understand the Neighbor's In-Laws where the original land owners that subdivided and layed out the road back in the 1930's

I am almost at the end of the road with about 10 homes total accessed by the road. The former owner of my place, since 1958, told me the post office would not deliver the mail individually in the early years because the private road was considered rural.

There is a common association to keep up the road that has worked well. The family with the Daughter does not contribute because they were Grandfathered from the start. I guess the old man was thinking ahead...

Because of what happened and because it could have easily happend to a child, the first step is the purchase of a 15mph speed limit sign to be added to the existing "Slow Children Palying" and "Private Road" signs at the top of the hill.

Rudy's death has served to unite everyone along the road.

What I don't understand is why the neighbor had acces to the road driving the way she did.

Bottom line is that if a road is "well ridden" by autos for whatever reason, I would think that it is the pets owners responsibility to make sure any pets are not within "striking distance" of said pet by ANY auto.

Again, if you know people drive the road that your pet may be on, keep the pet off the road.

Our house sits more than 100 yards off the "main" road in front of our house. Very rural, few cars actually drive down the road, some do at a high rate of speed.

ANYTIME our dogs go up near the road, we hit them with the "training collar" to let them no that "going out that way" is unacceptable.

This morning I was at my ZTR dealer getting some work done on my ZTR. A yellow lab was walking down the road (litterally) and had to "get out of the way" at least 3 times. It actually bothered me to watch the dog walk the road to the point that I called it to get it off the road. Needless to say it (the dog) didn't.

This might be a bit of a stretch from me, but I think our friend who lost his pet is taking and will take the needed steps to protect future animals or people from a similar fate. His first post dealt with his feelings about why the woman did not stop. I cannot answer this question, but my feeling is that she was hoping to not be caught and that in her mind she would not be if she fled the scene. So much for neighbors!!! I do not fault her necessarily for the action (although it is bad) but for her apparent inability to stand up for what she did. We live in a society that embraces "the other guy did it" philosophy. In his neighborhood, if he does not take the chance to stand for this value, this person ultimately will abuse it again. I think that is the original brunt of his post, and I wish him well. For me, I believe I would be at their home having a little talk.

When I saw Eddies post on how he left a note when he hit a pet, I just couldn't help but think "why did the pet's owner let the pet in question run by the road to be hit in the first place".

Honestly, Eddie did more than I know some drivers would do.

I know some people will disagree with me (as usual /forums/images/graemlins/smirk.gif), but if you leave your pet outside unsupervised, anything that may happen to that pet is ultimately (sp?) the owners responsibility for not taking the responsibility to watch the pet in the first place.
