i still say you guys are overly ****. I put 10 hours on my machine with the key off and the radio going while picking my nose. Still havent used it for work yet. geeeee wizzzzz. Seek help asap! 12 freaking hours to cause a big stink and cancel a deal wow just wow. So what if someone drove it around the lot a few times. i bought a brand new truck from a dealer in 04 but it was in another state with 5 miles on it. By the time the dealer drove it up to pa, it had 250 miles on it. I still paid brand new price for it becuase it was never registered. So what if the guy farted in it a few times and drove it. It was clean and still had same warranty on it. Still smelled new. I sure as **** put it to work and worked hard for me for many years.

I had that happen recently on a small tractor we thought the dealer lost by theft. Some jerk at the dealer took our new mower home and cut a few acres, three weeks later they want to return it. We said NO.

It may have been idled at low rpm for 10 hours. Who knows? My new tractor had very little time on it. The only time it was ran was while being loaded and unloaded.

Not sure i get your logic on the car being new just because it was never registered. Dealers let salesmen drive demo cars with dealer plates al the time. They may get sold with a few thousand miles, never "registered". Do you consider that a new car? As far as the tractor goes the op said the tractor bucket was obviously put to work and had scratches and wear marks. Hardly driving it around the lot a few times. I put on about 100 hours a year so effectivley someone was allowed to use my "new" Tractor for about a month. Doesn't work for me and as stated, it appears the dealer shipped the wrong tractor.

Back when it was mostly farmers buying tractors, it was common for the dealer to drop off a new machine at somebody's place for them to use for a few days or weeks to see how it fit in to their busy operations. If it was a little too big or small, the delaer would bring over another one, moving the first one somewhere else. All of the tractors eventually were sold as "new" machines, even if they had a dozen hours on them. Nobody got heartburn over minor wear marks.

If the dealer in this case actually painted over the demo scratches, he became obligated to make some kind of condition acknowledgement or adjustment.

I agree 100%. There has been several times Ive dropped a tractor off at a customers house and let them run it for a few hrs. Never have I had any problems selling one with a few hrs on it. Most of the time the buying customer drives it around on my lot and plays with it awhile to make sure that the tractor he wants and needs.

John is back from the dealer after a drive of over 200Km. I didn't see the smile on his face but overall he is okay now. He told me that the manager statement was: "It was a confusion which never will happen again". So, his theory was that the sale guy "accidentally" wrote a s/n from other unit instead the one which John was looking and the shop prepared that unit instead of the new one. Anyhow John said he learn two thinks plus another: check the s/n before sign the paper, write down the hours on papers to avoid any discussion and never trust a dealer.
Consolation: he got 1000$ on a prepaid card for fuel and the tractor will be deliver tomorrow morning. I told him, better check the card before.:laughing:
So it reads like John got $1,000 for driving 200km (or 400 if the 200km was one way) , a little grief, and taking delivery a few weeks late.

Reads fair.

With the dealer that far away I'm not surprised the dealer was upset to begin with, it must cost at least $1/km for delivery.

Below is from a previous post here. Would you sell a customer a tractor then drop it off for another customer to try/use for awhile to see if he liked/dislikes it????:confused::(:( Is that what you are saying?:confused:
It's about a MX5100. Why the guy is upset, is because when he did the deal the tractor shown 2 hours and the bucket was clean. Now the bucket was repainted and screched, so......
