YM 2000 on ebay

Sold.....? Or just.......gone? How can they stop a private party from selling something purchased legally?? I don't get it......

its been talked about here many times. I did not know at first. But due to ebay policy, because of the lawsuit on yanmar usa by the guys widow who was killed on a grey tractor, somehow its attached to ebay that they cant sell grey market yanmars on ebay. Thats why the ones that sell are often times called japaneese tractors and fuzz out the numbers and if you want other pics the guy will email them to you. Most prolly dont even know about the policy.

Same reason why you can bring a container of grey kuboo's into america today and set up shop selling them, kubota stopped that and now they wont clear customs, so your out your money and the money to return them if you buy a load of them.

Thanks for that. Interesting........I don't get how you can't use their name selling a USED tractor. Just doesn't seem right. I don't think it (ultimately) would stand up in court. But I guess they'd wear you right down with appeals, etc..............for ever.

I'm also surprised that ebay doesn't have the sack required to tell Yanmar that they can't be telling folks not to sell a used product aqcuired legally.

Remember copyright laws here in the USA. They have registered their name the way it looks and their design and how the tractor appears. They have copyright laws. Their wishes are that their name not appear, ebay follows orders as it wishes not to be sued for copyright infringement. Chevy could do the same thing and not allow us to talk about them good or bad even here as well as sell them on ebay, although mention and sales is good publicity for the brand as well as way to hard for them to fight, but they could if they wanted to.

I'd be very interested in learning what copyright laws have to do with reselling an object you have purchased. They are exceeding the scope of copyright as I understand it; the person you sell a copyrighted article to can certainly do with it as they see fit, as long as they don't reproduce it. I'll need a better explanation than that.

just use the farm paper and those iwwana ads and CL. You can use ebay but better write the guys name down and pm him and make him an offer when it gets pulled.

It's all been said. Google 'Ebay VERO takedown'.

Ebay has a problem with fake Rolex watches etc. They have a program where the trademark owner can ask Ebay to close auctions that the trademark owner doesn't like. Ebay will ban the seller if he re-lists.

This is legal under US trademark law. We may think its unfair but you need a change in US trademark law before Ebay will change their policy.

Consider the pursuit of pirate music downloaders by RIAA. This Yanmar issue follows similar legal theories.

Nope....not the same. A grey market Yanmar is not a fake. If they were selling fake Yanmars, I would buy it. Something smells about this.....it's un-American
