You guys are not reading the statute correctly...

Commercial Class A - Any combination of vehicles with a gross vehicle weight rating

(GVWR) of 26,001 pounds or more, provided the GVWR of the vehicle

OR...

(this is the key word)

vehicles being towed is in excess of 10,000 pounds...

That's where they get you...

Any trailer that is over 10,000 # is being towed requires CDL's...

Don't ask me how I know...lol

Again, I only feel this is for hire. But anyway we could all argue this till we are blue in the face. All I know is what goes on around me.

Your interpretation is incorrect.

read the staute again:
Commercial Class A - Any combination of vehicles with a gross vehicle weight rating (GVWR) of 26,001 pounds or more, provided the GVWR of the vehicle or vehicles being towed is in excess of 10,000 pounds.

"Provided" is the key word, not "Or". You must be towing a vehicle with a GVWR over 10,001 lbs, then you need a class A CDL.

Believe me, you don't need a class A CDL to tow a 10,001 or 11,000 or a 12,000 trailer for that matter until the weight of both vehicles exceeds 26,001 with the trailer being over 10,001.

You're interpreting the stautue as if it were 2 statements, rather than one statement.

I swear, there is nothing more confusing for people to understand with the possible exception of out tax codes than this CDL crap.

Right. That is why you can tow a 14K tandem GN trailer with a 7,500# 1 ton truck. You have not exceeded the 26,001# rule.

Of course, you also have to assume that the guy at the weigh station or the cop reads it the same way you do. :(

I just got off the phone with officer Fullbirght of the DMV office located in Newton, NC.

The law in NC changed as of Dec 2008.

If your total weight is under the 26,000# threshold total your trailer can now be greater than 10,000# and not require the class A license. The licesnse requirement for that is now a class C. The only stipulation is that it must befor personal use. I guess that they are trying to help out the personal use guy that is not business.

That's good :) Since non residents cannot get a "class C" can I assume (I know!) that non residents are okay with a standard license?

What didn't make sense to me was for NC to expect out of state licensed drivers to have the NC CDL license.
I could see the requirement applying to NC residents but the idea of enforcing it on out of state residents sounded assured to me.
I have an Ohio license and that should entitle me to drive in all 50 states not 49 22 10 43 states etc.

Yes, but you still have to obey the laws. Like here in Indiana we are allowed to double pull. That is 2 trailers behind one truck but its not legal in NY for example, so I could not double pull in NY and just say "well its legal back home" if I were to get pulled over doing it in NY.

I think that's an issue that just cannot be resolved. While I believe in "states rights", where do we draw the line?

Should Ohio cite someone from down south for having too dark of tinted windows, which are legal in their home state?

What about license plates? Ohio requires a front license plate, can we arrest someone from Kentucky because they don't have one and can't get one?

How is that different from what type of license someone has and can't get in another state?
