Heres an example i can relate:

A farmer spreads manure in his fields.

Neighbor doesnt like the smell.

Neighbor complains.

Which person....the neighbor's or the farmer's rights come first?

The farmer spreading manure is more than likely one from a long generation of family members to do so, not someone that just moved in, changed the landscape and told everyone that they just have to "live with it". People that move into a farming community know what to expect and they are either part of production or ok with it. Same goes for moving next to an airport. They already know through research that there is an airport nearby and should expect such activity. But when some guy moves next to you and decides he's going to clear an airstrip on his place and start flying over the house that tends to shock the general mood of the neighborhood.

But its the same exact thing. I never said the neighbour in my example was a new arrival. Sometimes people just get annoyed with something for they used to tolerate for no reason. Perhaps there was a conflict over a boundary line or whatever, but it happens. Once again, were only hearing one side of this story.

The key in this case, is you dont own airspace. Period. As a homeowner you have no control over it.You can complain, but its up to the powers that be what happens.

I believe the OP said that the airstrip was there but unused? until the new homeowner took over. If so it wasnt "some guy moves next to you and decides he's going to clear an airstrip on his place" and even if it was a new strip, if its been approved by the FAA and municipality (if applicable) than he has a right to use it.

Another thing is the strip doesnt get used that much, (only nice days) so how many flights are we talking about? A couple a week? and how long does the noise last? A few minutes a week?

I will say this, if the OP is saying the truth and I have no reason to believe he isn't then I agree with his position and would want the same if I was in his shoes. I have a small air strip about a mile from me similar to the OP's. The guy who owns it is great though and he does his best to just fly around and enjoy his hobby without disturbing others. I also have a county airport within a half mile from my one farm. The main runway is situated so that I have planes circling my farm there all the time. I enjoy watching the planes and jets come in but these planes are all quite high still and only seldom do I see any plane flying low (usually those planes are military and are just passing through).

The jets are loud enough to get my attention while in a house but all the other planes are just background and would not wake me up. So if his family is being woke up by the neighbor then I am going to assume his plane is flying way too close for comfort if it was my family living there. I hope everything works out for everyone involved. I have no problems with people wanting to fly and actually envy them at times but everyone should feel the need to be respectful to others regardless to what rights they think or know they have.

No, it's not the same thing. According to the OP he was there many years before his neighbor decided to turn his parcel into an airport. You used an example of a farmer spreading manure. One generally knows a farmer doesn't just show up and start spreading, he's been doing it for many years and those around him are familiar with this and many other farming practices, hence the term farmland or farming community.

wow, I sure am glad I don't live next to someone with an attitude like this. I hear some cyclist exclaim there right to ride down a busy thoroughfare in a large city. Is there claim legit, well according to the 4' wide strip the city painted for them it is but is it the safest thing to do? Not really. Neither is flying low over someone's residence no matter how many FAA reg you throw at it. Every heard of the saying being "dead right"? Unbelievable.

What do you base your assertion upon that flying low over a residence is unsafe? The plane isn't going to fall out of the air and he is obviously going to fly high enough not to hit anything. Just wondering where you're coming from on that?

The low flying shouldn't be an issue to anyone not in the plane. Sound is the only possible annoyance anyone should be concerned about and if someone is on landing approach the sound shouldn't last more than a minute tops. Not a big deal.

Pretty much no matter where you live, there are aircraft flying over your house everyday, albeit that they are higher, they still are there.

I agree that flying over the OP's house does not necessarily present an appreciable hazard. That is why their are no regulations against it, that apply here.

That being said, once again, this guy should not normally need to use ANY power, while landing in a 172, that would allow him to silently glide over the OP's house. Unfortunately, most are taught to do otherwise.

About the manure example: There is a regulation on the books, in my township, the any odors must be kept on your property. I believe our rules are pretty much the standard township rules, so technically the farmer would be SOL if someone, (at least here), wanted to complain. I don't know if this has ever happened.

I personally hate the smell, but I understand that they have to get rid of the manure. And, the cows were here first, so I hold my nose sometimes. (The cows are still some of the best neighbors I have ever had. Never any loud parties, and their kids don't play in my yard).

LOL, party animals.

A co-worker used to put all the Far Side comics related to cows, on my computer monitor. I always chuckle when I think of this one: CAR!
