With the strange behavior of "fixing" the fence, I'd opt for conversation.

Get a third-party mediator involved to find the cause of this behavior. You say she has money, court costs, surveys, perhaps some money can go to solving her issue in a manner that is less damaging.

I think that based on your descriptions of her actions, before you call the sheriff on her, perhaps discuss with him her possible mental health issues. Who is gonna whip out $1,600 for a second survey just because they can?

I had 3 surveys done on my place neighbor had 2. Our line had been surveyed 7 times in 5 years. Out of the 7 times and 4 different surveyors. Only 2 agreed and those 2 did it 2x's each and agreed each time. The other 3 were all over the place. A survey is about $500-$800 her if you pay CASH double if you don't. And we still went to court.

In this case, the OP said that the two surveys and the 3rd resurvey agreed exactly but her surveyor only marked the corners on the initial survey, they didn't flag the line like his did....

Wife just called me back, said she walked down to the property line. The neighbor is in the process of bending the T-post back straight and installing the top strand of wire! :confused3:


I hope that you can resolve this amicably. Are you documenting her removing the fence, i.e. taking pics?

Just out of curiosity, what state do you reside in?

Yes I know I was just replying to RockyMtn.Hillbilly that a lot of people have more than one survey done.

I just do not think that is good enough. You started with perfectly good, NEW, T-posts. After she bent them over and bent them back, they will look like a petrified snake.

Exactly, she destroyed a perfectly good fence and she needs to return the fence to the condition it was in before she destroyed the fence.

The only bright side I can see in her trying to fix the fence is that MAYBE she has realized she is out of line, pun intended. :laughing::laughing::laughing:

Not sure what I would do next if this was my land and fence, her actions have literally and figuratively crossed the line and I would a definitive admission on her part that what she did was wrong and would not happen again. That means in writing and if there is a police report it should contain what she said about her taking down the fence. Maybe the work I do with lawyers is showing through but I would contact an lawyer to see what options are available and I am not talking about lawsuits.

My wife is talking to the shift sergeant as I type this. I told her to tell him / her to send a sheriff out to the house. The wife has a copy of the judge's order, copies of the survey / blueprint / map. There is no reason for this woman to continually trespass on my property:mad:! She is even nailing no trespassing signs 30-feet into my property! These pictures were taking yesterday afternoon.

You know what they say about giving someone enough rope to hang themselves with... Methinks that she has done an admirable job of hanging herself (legally speaking)...

I say it is time for a restraining order. In some states you can get a Residential Property Restraining Order. At least this is another legal way to deal with it and possibly have her fined or arrested for braking the restraining order.
