You are assuming that JD will take $20K. They may. If they don't, then I'd go new.

That is a capital idea. However, if you CAN track down the seller, you may as well sue him. For a 1099 you need the other persons SSN or TIN, which may not be easy to find.

I agree the emotional part is an issue. But if you could find the original seller, he owes you 100% of what you paid him. Your current deal with JD is a separate sale. They can legally sell it, the original owner could not.

Seems pretty unlikely that the seller has any assets, but if he did you might be able to make lemonade from these lemons.

If he has any assets, I'd go after him. There are companies you can hire that will sleuth out the guy, find him, check for bank accounts, job status and so forth. It would be money well spent.

The 1099 idea is clever.

in 2006 I bought a john deere tractor and loader from a local dealer.a few months rocked on and the dealer called wanting to pick up my tractor immediately for warranty service they said on the front axle.they came and got it the next day and kept it a couple days.i got it back and it was all cleaned up.came home a couple days later and a john deere investigator had been at my house and left a card and a note instructing me to call him.well apparently this dealer was selling tractors and not paying john deere for them.the dealer got wind that john deere was coming in to check his inventory,so he had to round up a few tractors to put back on his lot.a guy I work for said they also came and got his for a few days and brought it back all cleaned up.the investigator wouldn't tell me much about the dealer,my first response to him was I wrote a check for the tractor to the dealer and had all the proof of where I did.the dealer went out of business a little while later.the other local deere dealer got all his inventory and he had several brand new lawn mowers in crates that was several years old.i was sweating for a little while though when I seen that an investigator had been here.

Yeah, I worked for a marina that also messed with the banks-they borrowed ("floorplanned") two or three times on each boat! They did pay off what they sold, however. I ran their warehouse, and a bank inspector (they check on their stuff once a month) showed up on the wrong day, met up with another inspector ... and people went to prison.

Just got a call from Deere financial today. I bought a 3520 from a guy 4 years ago. Apparently he did not pay off loan when he told me it was free and clear. They want to know when I want to make arrangements to surrender tractor. Am I up a creek without a paddle?

That's a nightmare, It's hard to believe someone would do that to anyone. Good luck to you, go after the idiot you bought it from, you may not get very far though, he is probably broke.

There are many examples of people doing similar things. It has become almost customary to try and take advantage of others.

The rule I grew up with, "do unto others as you would have them do unto you", has become "do onto others then split".

I have bought a bunch off from craigs list and am always very wary of people selling stuff they do not own. Generally if it sounds to good to be true it is.

And as far as going after someone after he's been proven to be dishonest - lawyer fees are pretty high.

The amount of things sold buy people everyday without issues tells me the dishonest are few imo and I really don't care what you find hard to believe in my post. I have no idea why you would waste your time even quoting me to begin with but whatever.

I historically (because I am cheap and can fix most things) buy used. But this thread has me rethinking any major purchase. The two biggest ticket items that I bought off of CL are $20K and $12K. No issues with either one but I think I will now keep the CL purchases down to under a couple thou so I don't have to worry about a knock on the door. :D

the very reason I buy stuff like this from a dealer rather than an individual .
I bought a 4 wheeler yrs ago from an individual. It turned out to be stolen. I lost my money back then. It won't happen again though

I'm sorry this happened to you. Like you, I didn't even know until reading your post that this type of scam existed. Shame on the loan companies and shame on JD for using such a loophole. Thanks for your posting. Perhaps the lawyer will offer remedies, I hope so.

But regardless of whether he does or not, I urge you to fight for your rights - all of our rights. It sounds like there are laws here that need to be changed, and it also sounds like the finance companies are taking advantage of those laws at the expense of the general public.

In my opinion, the people making the loan should be the ones responsible for protecting their own collateral. It shouldn't be up to some unsuspecting buyer to protect the finance company against some loan that they shouldn't have made and that a subsequent buyer has search out or lose out years later.

This is an example of a type of misplaced responsibility that could end up damaging our the whole concept of private ownership.
Hopefully this will get straightened out.

Good idea; I'd be searching for the seller for sure.
And I'd do a second and a third check of all the paperwork that I got along with the transaction just to make sure that a bill of sale was included. Even though it might not be signed by everyone and even if it was it isn't proof positive, it would still serve if the seller couldn't be found.

Here's a thought: while the buyer still has possession and use of the tractor..... and before any formal court order has been issued that requires it's repossession.... would it hurt to simply put the tractor somewhere else for safekeeping?
That's one way to keep everyone concerned with the buyer's rights as well as their own interests.

The OP is acting in a responsible manner as far as we know from the posts but rScotty is suggesting that he become a thief and attempt to hide the goods. For what reason? They know ho has the machine and he wouldn't gain anything at this point doing that. rScoty, seeks to project his dishonesty onto the OP.
