thanks guys, appreciate the support. asking about a loaner or some kind of deal on a new unit from the new dealer...will let you know.

Buy a tractor in July and still don't have a working unit for Christmas...hard to even comprehend.

I am wondering if the dealer has a unit on their grounds that they can get the part from. Just a random thought. Also I want to say that I feel for you and your father. My father went home in July of this year. I don't say this to garner any sympathy but to say that you have your dad right now and you can spend time with him in person. I don't have that option and that is what I miss. I want to encourage you to spend as much time with him as you can. In my mind it is more important. I want to wish you and your family all the best this Christmas. I want to be bold and unashamed-to say that that tractor will be fixed sooner than later and your father will be healed and whole I speak life and living over him in Jesus name!

thanks Blitzen...you are correct, we have to keep things in the right perspective. the dealer asked TYM if they could take the parts of a tractor on the lot (they have several) and that request was denied.

Bottom line that I am convinced of now...you better hope that NEITHER your TYM or Branson tractor ever needs any parts or service. They don't answer their phone (I have called many times) they don't return messages (I have left more than I can count) they don't respond to email or contact us forms on their website. They don't respond to their dealers either...basically after sale support is non existent.

I have their personal number as well...been texting all day...the issue is not the dealer, it is tym.

I see this a lot here for some reason. People expect manufacturers to deal directly with them. The contract is to work with the dealership. There should be no expectation that manufacturers will talk directly to customers.

That is not to say they shouldn't be working to resolve the problem. I'm working on a problem with another piece of equipment. My dealer is handling the communication with the OEM. I got a letter from the OEM through the dealer (they are replacing my unit). I just wish the dealership communicated more frequently. They are nice, but I have to initiate contact.

Well, I have to solve this problem. I was able to get the PN the dealer cannot get a response on from TYM so now I am calling around all over the country to try and find the part. which happens to be 12414342100M "case, final drive" OR one dealer is telling me that is the old PN and has been replaced by 13874342100m...working with big tex tractors parts departments now to see what we can find out...must say they have been extremely helpful even though none of this is their issue.

That is generally how things should work, but most manufacturers have a representative whose job is to work with disgruntled customers who aren’t getting satisfaction from the dealer. After all the warranty is provided by the manufacturer, not the dealer. Of course the dealer is supposed to do the warranty service and bill the manufacturer, but the factory representative is there to satisfy customers when the dealer isn’t able or willing to do this. I have contacted auto factory representatives at least twice over the years when dealers failed to fix problems.

You may want to consult with a competent lawyer.

Many state courts interpret UCC warranty law to mean that if the manufacturer does not timely make repairs under warranty or can't make the repairs, the warranty "fails of its essential purpose" and the manufacturer may be required to buy the machine back from the customer.

Have your dealer also try to call Jordan Sales in Post Falls, ID. They have the largest inventory of current TYM parts west of the Missisippi.
