I just checked. Wisconsin does not seem to be one of the few states that prohibits the recording of private conversations without the permission of everyone present.

You could slip a tape recorder in your pocket and go have a polite talk with the neighbor one more time. If he is abusive, tells you that he will do as he pleases on your land, or threatens you in any way, you will have evidence of his behaviour and his stated intentions. That and photos from security cameras should give any judge all he needs to be convinced that your neighbor is a bad actor.

You might also be able to get a monetary judgement if you decide to sue for damages.

I had not posted here much regarding the trespassing but since there are people who DO live nearby bordering your property.

I think you hve only a few GOOD choices.
1. I would probably take the pictures, make several copies, use magic markers & put on all the local phone numbers on one set of pictures. over to them with the local DNR phone number and the local police number, as well as a bill that you have from the road work. take a pic showing the damage to the road & any other property damage as well. tell them you have a good number of the game cameras hid in different places all over the property, tell them here is the proof of the damage and WHO did it (namely them) & that you have seen damage to the property as well as. Let them know that you already contacted a lawyer & that they will not only be paying to repair all the shown damage as well as loose the truck guns and all for illegal hunting from cars on posted private land. Let them know any further damage it will be taken to the courts, both criminal and small claims. Let them know you have talked to them for the LAST time the next infringement the cops DNR and your attorney will do the talking for ya. ;) This leaves them with the chance to stop being butt heads and do the right thing, them knowing you already have the evidence to take money guns trucks and possibly jail time from them I'm sure they will back off and even make sure no one else gets into the area...

2. bypass the talk & go straight to an attorney & the judge & DNR. good ole boys network or not when you hire one for your self things WILL change when the prosecutor sees the evidence... not to mention then file a civil suit against them for the trespass & damage. then make sure you get a bunch of tree hungers to set on the jury :D

This is turning out to be an interesting topic,and there is no simple solution,in this province some of the Crown land does have gates,the ones we used were very similar to the pictures posted in this topic earlier,to anchor in the ground we welded 2 45 gal drums together making a tube appox 6 feet long about 3 feet in dia.a 4 inch piece of pipe with a foot welded on was placed in "tube" than tube and pipe were filled with cement,than a piece of pipe 5 inches in diameter was slid over the 4 inch pipe,this was the hinge side. Now the opposite side the same procedure was followed however used 6 inch pipe; a 1/2 inch steel box was welded to this pipe with a couple of holes to accept a pin with a lock protected by steel. 8 years ago these gates cost the Gov. 3500 bucks to build and install. However even these gates could be destroyed,or if they couldn't bend,cut they would shove pieces of wood in the lock so the key wouldn't fit. The point I am trying to make is that short of manning private roads/property it is **** near impossible to keep the determined out.
Shortly before I retired we visited all the companies/landowners with private roads,aquired keys and made random patrols with marked vehicles starting before the hunting season as well as during the hunting season,even though only a few trespassers were actually caught word soon spread and I would be safe to say complaints dropped by 75%,the good part about this is that the land owner never became involved,which lessened the chance of retalitation. Example the fat guy sitting on the tail gate of the truck would of been charged with uncased firearm,as well as the driver,and all hunting equipment including the truck would of been toast. After we finished with these guys I don't think there would be any need tor the landowner to follow up.

One thing I don't suggest is putting a board full of nails across the road,seen it done by pi@@ed off landowner,that backfired. But thats another story.

How does that happen? Trespasser steps on the board and sues the landowner. Trespasser sees the board and moves it so the landowner steps on it.

You can't booby trap your own property (sadly) against the bad guys, because you might inadvertently get one of the good guys (LEO, fire fighter, paramedic, good Samaritan, etc) responding to a real or perceived emergency. It's the law in most places and a civil liability if you get the wrong person in all of them.

Unfortunately, in come places it is a civil liability even if you get the right guy. Most of us choose not to live in those places.

Nice picture. I love it that they will trespass, hunt illegally, poach and do just about anything they want, but still wear blaze orange. Safety first!!!!

I need one for my shop, got a neighbor that is from way off and when deer season comes around he always asks about tin I have around my shop that I only know about. I think he stops by when Im not here. Id also like one for the Landfill we run to take pictures of vehicles entering the parking lot while we are on the working face.
I agree on some hunters that go crazy during deer season. Ive had a big issue with hunters threatening dogs and putting out poison. In MS we have a law where on any private or public land its Illegal to kill or maim on purpose any dog be it a hunting dog or pet during any season. Its punishable up to 2500 dollars or a year in prison. I keeep my german sheperds up during the day and let them out at night to watch the shop and deter folks from parking around the house. Once in a while one will take off in the day but not often. Id like to have a camera on the side of my dog pen that borders the road in case someone did poison them over the fence.
I find it amazing the Hunting club members dont care about your tresspassing signs but want to jump up and down if you even drive down the county road by their club grounds.

Ain't that the truth! The trespassers have their land posted up tight and are very aggressive about keeping people off. The signs of other people are merely a suggestion that can be ignored! :rolleyes:


I was in contact with a different Warden today. The original one is being assigned a different place, so he is taking over the lease issue. They will be issuing citations soon on that case and he suggests waiting on civil actions until then as that will make the civil case stronger. :)

He also gave me a different Warden to contact on the trespassers. I outlined all my concerns in a lengthy email and was able to use the phrase "miscreant scofflaws". (Actually using vocabulary is one of my hobbies). He thinks there is excellent evidence in the pictures. :D

Oldtrout, - I like the way they treat this issue on Crown lands. Actually, it is supposed to be the way they treat it here too. Only time will tell if it occurs. In my note to the warden, I outlined my concerns. That letter can probably be read verbatim in court to get an order of protection (or what ever it's called) against them. Our very real fear is that the drunk idiots see a deer jump up and start snapping off shots with out concern for where the bullets land. We hear them drive road hunting and then 4-6 shots in quick succession. Due to that, we have abandoned that portion of the property during all gun seasons. It's just not worth getting shot!
