I quoted all the relevant posts I made previously about this frustrating "return" situation just to refresh everyone.

When I said friday that I had called and talked to the owner this time and not the belligerent shop manager....That must have been Bryan. Because on their website, they have listed Bryan and Robyn as owners. So when I called Friday....it was the shop manager that answered. I knew I didnt want to talk to him so I just asked if Robyn or Bryan was available.

Well it must have been Bryan, because today I got a call from a woman....Robyn.

She just wanted some more details about why I sent the block back before the refund was processed.

And (you all have seen the pics) I just told her that I was guaranteed a rebuildable MX5100 block that needed NO machine work. And that the block I received, and sent back, had a bore .003" oversized, deep scratches in the cylinder walls, hot-spots on the pistons and cylinder walls, AND WAS THE WRONG BLOCK....as it was NOT out of a TURBO tractor.

Well she flew off her rocker. Saying they had their "shop" check it out again and everything was in spec and perfect. The cylinders, she said were as smooth as can be and cannot even catch a fingernail in them scratches....and (this is funny), some emery cloth would take them scratches right out. She continued to defend her stance, saying she'd have no problem running that engine in her L5240. And asked me who I had check it (the block) out because there is nothing wrong with it. I told her I was the only one to lay hands on it and there is NO WAY I'd just slap new rings and bearings in that wore out block. The she said something like "you dont sound like your older than 30, how many of these have you actually worked on":laughing: But again I pointed out that regardless of the condition of the block, ITS THE WRONG ONE.

So she accused me of changing my story everytime I call, and that this is the first time I have said its the wrong block. And the shop manager told her that I said I "though" it was the wrong block but didnt get that far into it. NO. I SAID FROM THE BEGINNING IT WAS THE WRONG BLOCK. (But had it actually been "rebuildable" I'd have had no issues using MY cam. Which is why I pointed out all the other damage to their WRONG BLOCK).

This whole time she is very unprofessional using profanity just like the shop manager. Nothing serious, Just the 4 letter d, S, and H words.

She also accused me as being the reason they fired the girl (who just had a baby) that sold me the block.

In the end she said she something like: "You've already cost me enough money and a good employee, I'll refund your $1750 but you're eating the freight charges"

I said I would be calling my CC company. Which I just got off phone with
Your a total jerk. Anyone with any scruples would keep that hunk of scrap iron. That poor girl wont be able to buy formula for her illegitimate child now. LOL! Come on! What in the world?

Oh I forgot, YOU MADE THEM FIRE HER.

HAHAHA!

Based on my experience with contesting dishonest things with CC, it will take a little while, but you will get your money back. All you have to do is tell them you want to contest it and tell your story (the truth) and wait. Ebay has been good doing that too.

Its in the hands of the CC company for the $376.xx balance.

They issued a temporary credit to my card, and submitted the dispute to the vendor with the information I provided.

I provided them dates/names and summary of the phone calls I have had very similar to what I have posted here. Also included the pictures I posted here.

I submitted all this stuff on Friday 10/19.

I called CC company yesterday 10/26 for update. Basically they are awaiting a response from the vendor. My understanding is they will either submit to refunding the money, or can dispute it as well. Then it will be a back and forth, CC company hearing each side of the story, and ultimately making a decision. At least thats how I think I understand it.

But the vendor has up to TWO billing cycles to respond. So this could go well into december and beyond before its all over

If need be, you might want to refer your credit card company to the BBB history of West Kentucky Tractor Parts.
Sorry to hear about your problem, but it is good to know information for the rest of us.
I have called West Kentucky Tractor Parts in the past.
That will not be happening ever again!

I know this is off topic but when I was getting married we went to a local place so I could rent a tux. While there my mother and sister bought a dress. Between that and the 4 suits we dropped over a grand at the store. About an hour before the wedding is to start I get dressed and within 5 minutes the rear part of sole starts to fall off one of the shoes. At first we took it as a joke, you know, the funny stories you get to tell about all the things that went wrong. The photographer even took a picture of us using super glue to fix it (a close friend ran to the hardware store). With shoe fixed life is good. Until the second shoe falls apart while I'm walking to the alter. Ok, fix that one so I can take pictures. Once inside I remove them and just walk in my socks. Suddenly I get called to the dance floor, forgot all about that otherwise I would of gone to my room and got sneakers. So I'm doing slow dancing to avoid putting too much strain on the shoes when suddenly the front part of the sole come off the first shoe and I nearly fall into the cake stand. After that the shoes spent the rest of the night in the corner of the room.

So here's why I'm sharing. When we go to return the tuxes I tell the lady what happened and she looks at me with a blank stare. Not much more than "that's too bad" sort of look. I then ask for some compensation as it did impact our wedding day (we didn't take all the pictures we wanted because I felt walking any distance outside was just asking too much from the shoes). I would of been happy with a couple bucks, a gift card, something. If she had been more understanding I might of dropped it. But she said that she would call the owner. After a minute or so on the phone she has the phone to me. I'm think I'll get an apology. Nope the owner says he's not going to charge me for damaging his shoes. Mind you these are from a national rental company so they are not his. I asked him to repeat it because I thought I heard him wrong. Then he started yelling at me. When I told him I didn't think I was asking too much he hung up on me.

Now I'm mad. So I documented everything that happened and on every wedding site and gave his company the poorest review. A day later I get a message on my phone (they had it on the rental agreement) from him screaming at me how he was going to sue me. So I called him back and and we yelled back and forth. I finally said I'm not 19 and you can't push me around. I too have a lawyer, a pretty good one and she would be happy to go to court but expect me to counter sue. I also told him just before I hung up that I was going to update my reviews with out latest conversation (which I did). That was the last I've heard from him but as far as I know my reviews are still posted.

My point is that I don't understand how some people run their business. It's like they take everything personally and if you aren't 100% happy you've personally insulted them. I guess they count on enough new customers to offset the ones they loose. Chances are anyone who has read even part of LD1's dealing with this company isn't going to buy from them.

I've successfully received credits even from merchants who had very clearly defined no refund policies or if I was outside of the return period. If you have returned an item, you'll get your money back, that's the bottom line.

From a merchant perspective we've had people order from us, we deliver the item, and then they do a chargeback. Even if they never returned the item, the credit card company sides with the customer and there's nothing we can do about it other than write off the lost merchandise as fraud.

In your case LD1 I am 99.99% sure they will side with you.

Yes the item was returned. And yes they gave my money back....all but the shipping.

According to some other reviews....people were told they have a clear "no refund" policy on shipping charges.

And I'd be perfectly fine with that had I changed my mind....or sent it back with no wrong doing on their part.

However...when they told me it was a MX5100 short block....and it was a MX4700 short block which CANNOT be made to work on a MX5100, thats their error and THEY should pay.

As it stands now, They got their part back, refunded what I gave them...so they have inured NO loss for THEIR error. While I have lost $376 for shipping me the WRONG part. I honestly dont know how some people sleep at night thinking this is a good business practice.

If I order a black shirt from your store and you ship me a green one...thats YOUR mistake and you eat all costs and make the buyer whole.

If I order a black shirt, decide I dont like it and send it back and want to exchange for a green one....then I would be just fine paying whatever shipping charges.

Its that simple...whomever made the error should eat the shipping costs IMO
