Yes - withholding payment will only hurt the OP and his credit rating

Farmer about 30 miles south of me - brand new JD 6000 series. Bought brand new just about this time of year - two years ago. Something dreadfully wrong with the on-board electronics and - apparently - several of the operating software programs. JD dealership loaned him exact duplicate while they brought his in for repair. Eventually they told him to come in - complete new paperwork and the loaner was now his. I never heard what was wrong with the first tractor and I don't think Nelson(farmer) did either.

It probably doesn't happen often - I read of a couple here on TBN - but it is an option that some dealers have taken. I mean - - what in the world are they going to do if they can't fix it within a reasonable period of time.

Granted a 6000 series JD - this time of year is just being "waxed up" and made ready for about three months of 20 hour days - harvesting wheat, tilling and replanting. Pretty easy for a big time operation to suddenly go from green to red or blue or some other color. Priorities my man - priorities.......

Its called bustin' your A S S to satisfy your customers

Yeah, it is a tough situation and unfortunately a lot is on the dealer.

I think my point was when an item is financed and used as collateral, with a serial number, it is more complicated then just take it back and give me a new one.

It can be done, but it is a process.

If a repair cannot be made in a timely manner, then the buyback is the proper thing to due. Unfortunately, many times it takes a lawyer to get the manufacturer to do a buyback.

The dealer can do it on his own but he will loose.

Now in your example, the dealer did what he could for what was most likely a repeat customer with a commercial operation that is an ongoing revenue stream for the dealer.

wagne223 - your last statement is the absolute truth - farmer has been loyal JD fan and used specific dealership thru three generations of farmers family. I'm VERY CERTAIN that this is preferred customer service and would not be what might be expected from a one time purchaser. Plus the situation is serious, this time of year, for a farmer who lives and dies with the operation of his equipment. For the average Joe, on TBN, it would be a nuisance, irritation but not affect your livelyhood.

Well the dealer called me around quitting time yesterday to tell me that they have found the problem and think they have fixed it but would know for sure this morning. When the 3rd function valve was installed (the way it was intended to be installed from the engineers) it created a bypass basically for all the hydraulic oil leaving the hydraulics weak and not functioning properly. As of last night they were pretty confident they had the problem fixed but wanted to leave it so they could make sure that it was 100% fixed. They said they would call me back today and let me know.

Well I'm sad to say that the problem isn't fixed. I can raise the backhoe up in the air and actually watch the boom drift off. The outriggers will lose pressure and when you try to apply pressure the to right one it will actually lose downward pressure. I left the loader up 4 feet overnight the day they dropped it off and it was sitting on the ground by the next morning and what makes me so mad about all this is that they said the performed that same test and it passed meaning I feel like I was lied to. I called them back Friday but they were not at work so I'm calling them back this morning.

Withholding your payment is a poor decision. That only hurts you and your credit.
Also they are not just going to give you a different tractor. It simply does not work like that.
The dealer would have to buy back your tractor, pay off the loan, then sell you another tractor with a new loan. All at a huge loss to the dealer. He may recoup some from the manufacturer but that will take a while.

Anyway, best you can hope for is a quick resolution to your issue.

Agree.... the ONLY thing that will come from this is that your credit will go to poo... and you will still own the tractor and in the same spot.
