Lemme see if I can summarize;

1. Larger parcel of land designated agricultural
2. 7.5 acre parcel subdivided out of the large parcel
3. You built a house on the 7.5 acre parcel
4. They now designate it residential effective 1 year prior to you building on it.

Was the one year earlier when you subdivided it?

Also, getting other people's opinions is fine, but zoning, land designation and taxes are local. So, while asking here can be academically interesting, it won't apply to your situation. I suggest you contact a lawyer who specializes in real estate.

almost the exact same thing happened to me. Bought 7.5 acres. built home, all 7.5 acres is taxes as residential even though 6 acres was still being farmed . I wanted 1.5 residential and 6 taxed as AG. Tried to fight the original asessment, Township told me I had to be declared a farm by the Monroe County farm bureau. Monroe County farm bureau stated if I don't own at least 10 acres they won't even consider it. Game over, I should have bought 2 or all 3 of these lots when I had the chance.

Only you can determine if this would work for you but..

I sold my neighbor some wetland from my property a few years back. This might apply to you because you mention wetland.

He only needed 1.5 acres to qualify for our 10 acre minimum current use statue. He combined the land he purchased from me with his lot & now only has to pay taxes on 2 acres of residential land instead of 8.5 acres.

The neighbor paid all costs, I just supplied the useless wetland.

Today was the grievance day down at the town hall and I thought I had a reasonable case.

1) my land is 7.5 acres of which 2.25 acres is ACOE wetlands. one of the documents that I read from their web site said that one can have an agricultural designation if the parcel is more than 7 acres plus part or whole is federal conservation land.
2) the change of assessment was for 2003 and I didnt move into the house until august 2004.

1)No good- to be agricultural land it has to be used for agriculture and produce more than $10,000 in revenue. The part I read referred to the fact that any payments that the feds made for you not use the land could be set off against the $10,000 revenue hurdle.(That does not come acrosswhen reading the document)

2) doesnt matter when you take possession of the house its when the application for land use change is approved.

Shame I had thoughts of going back and claiming my sales tax that I paid on the tractor and all the other implements
