There was a time when bad things happened, people worked through the issue and moved on with life. Now people want to find someone with deep pockets, blame them and sue them. Sad. I wonder what it's like to live with so much bitterness and anger?

That was before the days of downright fraud and corruption to make more dollars. Yes, I agree that sometimes bad things happen, accidents we used to call them. BUT, when the oil conglomerates can't...no...don't...make a fuel blend to make it through winter without jelling, something is VERY wrong. MANY people dropped the ball on this one. It cost a LOT of people in time and money. Why not get compensation? What were the oil companies profits last year? How many BILLIONS?

We bought that fuel in good faith. We paid money for a product that didn't live up to the standards that are expected of it. So, we want our money back AND compensation for our troubles. What is so wrong with that?

If you buy a pepperoni pizza and it has no pepperoni, do you want compensation? If you buy a hamburger and there's no meat, do you want compensation? How about a car without brakes? What about gasoline that is full of water? How about fuel that doesn't have the correct anti-jell properties? Is that "bitterness and anger"? No, it's getting what you paid for. I want my money back if I don't get what I paid for. I want EXTRA money if your (knowingly) poor product caused me HARM. If you're leaving out the pepperoni, the meat, the brakes, for the sole purpose of fleecing your customers, you should be taught a lesson. Agreed?

I saw your comments as someone who would leave McDonalds after paying for 5 meals and only getting 4, and say..."Oh well, it was an honest mistake". Wanting ALL of what you paid for is not being bitter and angry...it's wanting what you paid for. One or two people getting some bad fuel is "understandable", things happen, accidents happen. Thousands upon thousands...no, that is a problem. A problem deserving of compensation. It was no accident.

You can think what you want. I'm as anti-lawsuit as the next guy. But THIS is a case where it should be used. These guys screwed us. They left out BY CHOICE key ingredients necessary for a suitable winter fuel. It was NO accident. It was too widespread. These guys tested the fuel to a certain (not very low) temperature, figured they'd play the odds, saved a penny or two a gallon by only putting in a little anti-jell compound, it got colder than they expected, they lost...no WE lost. It wasn't THAT cold this winter was it? Was it a record freeze? If it were, I'd forgive them. But when the fuel doesn't make it through a pretty average winter...they ripped us off...they were being cheap...we should be compensated.

But, you know what...there won't be a lawsuit. Because the oil companies made billions in profits and have tons of money for lawyers. REALLY deep pockets don't get sued much...it's pointless, they can outlast you in court.

The moral of the story...don't forget to add anti-jell to your fuel because the oil companies are NOT looking out for your interests.

I now wonder what ELSE is lacking in the fuel. Maybe we ALL need to be adding our own additives...just in case...

I use Stanadyne Performance formula year round, 2 oz per 5gals. It's also approved by GM for diesel use. I've used it since 2001 with no fuel issues yet.

No...no...no...you've got it all wrong. I don't see a conspiracy...I see corporations out to squeeze the very last possible fraction of a cent of profit out of their product. I see corporations who in going for that last 1/10th of a cent profit made a calculated decision. Just as ALL businesses make calculated decisions.

For example: If you're an electrician wiring a new house you use "standard" gauge wire. You COULD use a lighter wire and never have a problem IF the owners never tax the circuit. You'd save money on the job but later it could (and SHOULD) come back to bite you.

They took a chance on what they thought the lowest winter temp would be and formulated for that. Well, it got colder...not a record cold or anything, just colder than they anticipated. Well, since they're in the fuel providing business, we as consumers TRUST that the fuel we buy will WORK as it should at "normally low" winter temperatures. It didn't and we were ripped off. They're the "experts" we rely on them to formulate fuel correctly and NOT to jell at non-extreme low temperatures. Face it, they were cheap and I think it should bite them in the ***.

Question: ARE there standards for how low a temp fuel must remain stable? If not, I guess we need ANOTHER law to keep greedy corporations in line. It's sad really that they're so cost conscience that we NEED laws to keep them in line. So, no conspiracy, just another corporation out for ever increasing profits.

And last winter, these different experts at every oil company decided to squeeze the last fraction of a cent profit out of their product by scrimping on anti-gel additive. So, no conspiracy, just an amazing coincidence.

I still put the blame on the Govt. Inadequate testing standards and a push to get ULSD to the pumps. Now that the additive manufacturers and fuel suppliers have had a year to actually work with the fuel I doubt there will be as much problem this winter. I say "as much" because fuel quality can vary so much from supplier to supplier. Diesel fuel is very geographically regional in it's quality and winter characteristics. It greatly depends on where the crude it is made from came from.

This situation was most likely not from biofuel, as it was probably 5-6ys ago.. etc..

Actually in class action suits I dont think you have to have someone damaged in the classical sense. My friend is an attorney and they won a big lawsuit with Hewlett Packard. HP Printers advertised on the outside of the box that they came with an ink cartridge and showed a full cartridge in the drawing. The reality is that the OEM cartridge was only about half full. A class action suit was filed over that and the company settled for giving everyone that had gotten the half full cartridges a voucher worth two free cartridges for their printer. No one actually had damages but the people who had bought printers did not get what the advertising on the box led them to believe they would recieve. You might be able to make the same kind of case against the oil companies. However if you do try to file that kind of lawsuit I would not reccomend going hunting with Vice President cheney.
