Got my Tractor, hydrolic line busted after 4 hours use

Boy did I get ripped off. Its a 1966 tractor, but they said 1976. The loan papers say 1976. the Kelly front end

loader says 1985. The dilivery papers which I didn't read, say different.
But I think my loan papers are the legal ones.
The product code is 6 M 1 3 meaning 1966, Dec. 13th. and there is not stamping for the time of day on the tractor. A

for midnight, B for morning, and C for afternoon. Boy they seen me coming.

yep.. the '5' in themodel number is the clue.. it would be 'D' if it was a late one.
still.. it's a good machine. too bad they were not honest with you, since they should have known what they were

selling. it's not like it's a secret what the numbers mean.

No way am I going to stand for this, something will be done about it. Several suggest contacting the Attorneys

General and file fraud charges, but not untill I hear from them to see where my 1976 is.

Not to play attorney...

Without a meeting of the minds there can be no contract... a ten year misrepresentation would support rescission of the contract in my non-legal opinion.

As with any issue... time is of the essence.

Attorney's general wont do a thing. You can file a small claims case against them for a few dollars. Getting a real attorney on your side will cost you alot of $$$. I tried the att. generals office route once on a real estate fraud thingy here in Idaho, and they responded that i need to hire my own attorney. they only get involved if it happens across state lines, and then only if the case merits their time.

WEll I am in Missouri, and they are in Indianna. Thats a state line, and the sale total was over $12,000. with additional impliments.

what contract, or do you mean the loan agrreement. It was all done by phone and a picture and his word. a few long conversations, and exchange of details on the tractor and over a dozen calls questioning the year of the tractor to the salesmen, and the owner, who claims to hve personally went out and inspected the numbers, then checked them on the computer, and called and told me what the numbers were to assure me they were athentic.
If you look at enoug picutes you can tell the difference between models, and check also engine speeds, horse power, PTO, tire size, i questioned this and they said they double triple checked. so I believed them. Seemed to me a tractor 10 years newer would be a better option for buying tractor. So many model changes, updates or upgrades, and the tires would be newer if not replaced with newer ones. So I concidered it all, I just didn't go eye ball it personally. I relied on others.

Look at their website, its amazing. Classy, so very infomationand clean looking. So who would expect these people of makeing a 10 year mistake on a tractor. I think it unheard of and practically impossible. but they did seem rather busy or at leaset said they were when I called. Of course everyone was gone Friday June 24th, I guess they all took the day off, the only one in the shop all day was the part people anwering the phone when it rang, it was usually busy. I called every hour all day long from 8:15 int he moring.
I can't sleep can't eat, I am 100% service connected veteren for a nevous seizure disorder, and cronic depression. This is unbelieveable, them not getting back to me. I don't know what I will do all weekend now. Take some pills I guess and mellow out. They give me prescription medication for my anxiety attacks, panic attacks, depression, diabetiees, blood pressure. Who nees this ****, i ask you. I just can't believe this is happening to me again.

Ervin, apparently you have it financed since you mention loan papers.
I would first go to the bank or wherever you had it financed and lay it in their lap. Tell them your whole story and that you and the bank was defrauded.

They actually own part or maybe most of the tractor, so they also have an invested interest in it. So they should fight to get this resolved.

Try not to let this get you down. Everyone makes mistakes or have had some unforseen problems occur in their lives. Some far worse than yours.

Seems this discussion has run it's course and it's apparent the Dealer and Buyer have different versions...

Buyer believes the product was misrepresented

Seller believes it is case of Buyer's remorse... based on my conversation with the Seller a few minutes ago.

When both sides cannot find common ground... the choices are to either let it go and move-on or turn it over to the legal system with all that entails...
