total dollar vaule.. yes. difference in 66 to 75 maybe not though. though we.. or I don't know all the particulars of pricing and the financing.. etc.

i'd guess that small claims may be up to a few thousand bucks.. and that should be the difference needed, easilly to cover a difference in value.


IMHO.. the seller could make a 'save face' out of this , in my book, by fixing the clutch issue. he'd likely come out ahead doing it at his own cost.. ie.. his own parts and labor.. vs just paying out of pocket because he's not wanting to admit he can't read / decipher a date code or model ID ???

Small claims is 5,000 dollars, but they take into account the total value of the fraud.........which is 12,000. That's a felony in any state.

That dealer has a major problem if the OP's numbers are correct.

EDIT: The OP has the right to go to small claims court to get the difference.........if he so desires.............but the 'supposed fraud' involved is definitely felony territory.

i'mnot wanting to hard time the seller.. but I'm all for getting crooks behind bars.

if this was an 'oops' incedent.. then it could be made right.. if not.. then.. well.. whosegow.. :)

IMHO Ervin you should have done alot more to ensure what you were buying was mechanicaly sound and should have investigated what exactly you were buying.

In this internet age we live in we have tons of info at our finger tips in seconds and can even reach out to forums like this or several others to get advice. Ervin you dropped the ball and now you are going to have to deal with it .

Whenever I buy used equipment I go into it assuming someone is going try and sell me a POS...so, when I find a straight up good deal, I'm pleasantly surprised.

He knows he is in error. The loan aggreement says a 1976 Ford 5000 tractor, and a 1985 Kelly 800 loader and bucket.

The delivery papers say. And I quote:


Unit Sale: 1966 OTH 5000 FRD Tractor
stock number:8068 Serial number: C159450

and

Unit Sale: 1980 OTH 800 Loader
stock number:8356 serial number: HOWELL

Loader Mounted on Tractor, Both pieces delivered.

This shows that as of the time they made the delivery papers up, they knew exactly what the year and everything was about this tractor, but they shipped it anyway. They knew right then and there, they had quoted the wrong information or they should have known.
They also misrepresented the Kelly front end loader and bucket. Loan says 1985, delivery papers say 1980.

It is funny though, after having it the short time I have had it, and fooling around with it. You can get used to having it. But, I do not want it. period, to big a difference in years, power steering upgrade and engine upgrades. These two things alone make all the difference in the world when it comes to any repair cost ETC ETC. And I would think, loan value too.

Ervin, seen these posts you made in another thread.

Did your brother loan you the whole amount or did he co-sign for the loan?
Either way, he has a big investment in this tractor.
By his being generous in helping you get the loan, you need to be careful he doesn't get hurt financially because of this. Deep pockets or not.

Yes, my brother will be helping me with this. Help helped me buy it. But is throughly pissed about what Rudolph Bros did to me about the year difference. He is thinking about us getting a lawyer and sueing them for fraud. Monday we are going to the Lincoln county prosecuting attorneys office and file charges.

Why didn't you figure out what it was before buying it ?

Why did you accept delivery ?

Why did you use it and break it ?

Why do you feel that it is someone else's fault that you did not find out what you were buying ?
