I promised myself to try to not think about this until the end of the month - a sanity break.
Anyway -
The neighbor was deposed (I mean that in a legal sense /forums/images/graemlins/wink.gif ) for two days and we finish up with him in a couple of weeks. We have him on several "mistatements" Based on what he has heard my lawyer feels the is no basis for their claim of damages. His wife will be deposed after that.
The neighbor called the sheriff twice recently, once he saw a red light and thought I might be pointing a laser guided gun at him /forums/images/graemlins/shocked.gif , another time his attorney's assistant was at the property, installing video survelliance cameras, when he says he saw my toe over the line - calls me an a**hole and calls the sheriff demanded I be taken away in cuffs. what a blowhard.
Now they have gone back to the previous owner of both our properties and purchased a quitclaim deed for all "residual" property claiming land out to the hight tide line, claiming the levee (on state proerty), and saying if I go out there I'm tresspassing etc etc
They have again closed the flapgate - the intial reason was flood control - but now winter storms are over - so the only reason is obviously maliciously trying to dry up my marsh.
We actually have a court date: October 31. and mediation once again, sometime before that.
What a melodrama - I can't believe you guys can still follow all of this - maybe I should start a collection to fund the movie.
So now I go back to the fun stuff - see my posts in projects and rural living regarding vineyards.

Just unbelievable!!!! That is always what comes to mind when I read the up dates. I would defiantly anticipate a bootlegging charge as soon as the grape vines start to grow.

I keep reading, hoping to get into the mind of your antagonist. I got hooked when I spent a couple of hours reading the saga for the first time a few months ago, then realizing there was no end yet!

Makes me feel very lucky. I bought our property in November, and the property next door just sold a couple of weeks ago. The fence between is barb wire, and is on his property. I want field fence, because the dog manages the barb wire just fine. I talked to the new owner this weekend, offered to provide the fence and the labor if I could use his posts - and he was enthusiastic, will help to install. So, for about $200 worth of fence, we have a win-win solution.

My wife and I are finally beginning our search for our 10 - 20 acres in the country. I've decided that I'm going to print out this post and give it to my realtor with the warning that he BETTER make sure nothing like this happens to us! /forums/images/graemlins/wink.gif

Nothing radical to report.
The neighbor gave his depo, his wife gives her depo in a couple of weeks, another attempt at mediation is shortly after that and a trail date has been set for October.
Had Fish and wildlife, the Corps and fish and game out recently to "evaluate" the wetlands. Now my neighbor is contending that the ponds are seasonal, dry up in September and just have occasional "upswelling" /forums/images/graemlins/confused.gifof water from the river. I hired a hydroligist that produced calculations that prove that only so much water can go thru the 36" pipe, producing a muted tide. Now we just have to wait for fish and wildlife's determination. This thing has taken on so many subplots that I almost forget it's about an easement.
