The county / state put a lien on her property for the adverse possession lawsuit. I'm letting the county pay, forcing her to pay for my fence. She had to pay $900.00 for court costs. It seems as I remember one of the judges telling her she had to have us paid in full by July 8. I got a feeling July 8 she will go into court and say she can't afford to pay this off. If the judge lets her off, I got a feeling I won't be able to keep my mouth shut. So I'll end up in jail!
Several months ago I was down on the property line with the tractor. She came running out of her house, and just watched me. I idled down the tractor, and told her to go get my money. She just stood there. I told her you trespass on my property, destroy my property, then won't pay to replace it! She turned and went back in the house. Now when I'm down there she won't come out.
We have a protection order against her. She can't get with in 400-feet of our house. We need to renew this by the end of May.

I have been enjoying this thread.
I have a few hundred acres in S. TX with a neighbor "lady" who has 32 acres. Years ago I asked her to go halves in replacing our common fence. She declined. About two years ago I replaced some fence up to one of our common corners. Last year she asked me to go halves in replacing our common fence. She had a surveyor come out and find the property corners. One corner was about 6 feet from the old fence posts and the other was 6" from the H-brace post that I had put in two years ago. She insisted that the new fence had to be on the property line. I did not have any problem with moving the one 6', but when I suggested we leave the other one rather than pay to have it moved 6" she again insisted. So, I ended up paying half the labor cost to move the post 6". I figure she gained less than 0.10 acre by moving the fence. She still was not happy because now she could not find the survey stake. I told her the survey stake was probably inside the new pipe post she insisted be put in.......
Whatever.

Shield Arc, please keep updating this thread. Just finished reading it start to finish.
I too had/have a druggy neighbor that was batshit crazy over the property line. Started a few years ago that my propane tank was on her side. This is just empty space between us not being used. Anyway, I rechecked the pins, made sure I was right and said hellwithit and moved the tank back some on my side.
Got worse and worse. Couldn't really show my *** because I work out on the road and house sits empty but camera'd up for months at a time. Great neighbors on other side of her keep an eye on things but always was uneasy about leaving the place.
She brought people in to recheck line and they told her same thing.
Finally one night, her house caught on fire. (Be nice, I was first to run over there and drag her drunken *** back out the window she was trying to climb into!)
Insurance bought her a place back in town. I have a standing offer to buy her 1 acre but she'll never sell it. Specially to me. I own everything around her too front back and both sides.
Reminds me, I still have to go get another gas can I've misplaced somewhere....

I wouldn't joke about a fire.

Rather than being confrontational, maybe calmly say "Judge, is this woman is playing the court for suckers?" (by continually refusing to pay). You're gong to get what you're going to get anyway so might as well take the high road and get under the skin of your neighbor some more. Nothing would please her more than to see you in contempt of court.

Speak short and to the point questions and don't elaborate.

I do not recall how much you are owed, but if I had a lien I would foreclose it.

At least in Indiana you will be junior to the mortgage if there is one.... BUT when you buy at sheriff's sale you own the property. So you can evict the evil woman. That will mean you likely never see the $$, but you have this woman out of your life. Well worth thousands of dollars.

I cannot imagine living through this scenario.

The lowest bid to replace the fence was $3,500.00. For some reason the court cut the bid by $293.34!:confused: So she owes us $3,206.66. To date she has only paid $565.00.

More good--and free- advice for court is: When you don't know what to say, don't say anything. That ticks off the defendant, earns the respect of the judge and can make someone look brilliant and reserved when they are on the edge of losing it. Heck, that's how I got through life.

Man I wish I was licensed in your state. I'd love to foreclose on this woman. I guess I say I would do it if it were me, but that is easy because it would just be my time.

For $3k it is likely not worth it, but you would have the satisfaction of kicking her out of her house.....
