Having dealt with something like this last week (A dented refrigerator), I can guarantee it's the shippers responsibility.
If they accepted the item damaged without making a note on the Bill of Lading, they have no way of proving the damage did not occur on "their watch".
That being said, if the dealer did not note the damage when he received the unit with-in the specified time (48 hours?), then it's his problem.
Was the unit dropped shipped? If so, how in the world would Kioti know it arrived damaged?
Too many variables and unknowns (to us at least) to make a blanket statement that Kioti and it's dealers can't accomplish anything.
I, for one, have had no problem getting parts/answers from my dealer.

I know that the paint could be done very well by the right guy with the right equipment. This is an identical situation to the weld repair where it could be done right or it could end up ruined. This time though, Kioti was warned.

PLEASE! I resent that last statement you have made!
Most of us dealers are plenty capable of performing our tasks with out a hitch.
I am very sorry that you have a dealer that you are working with in which you can not get satisfaction from.
But please don't make it sound like all of Kiotis dealers are idiots.

But please don't make it sound like all of Kiotis dealers are idiots.

I think your anger toward Kioti has clouded your reasoning. When anything arrives damaged, I don't know anyone who assumes it was shipped in that condition. It is very unlikely that Kioti shipped you out scratched up loader, and you're blowing that aspect out of proportion.

Your anger is even seething over into your other posts, such as telling the guy with leaking hydraulic lines that he should "check the loader for cracks?" Your way off base in my opinion.

It's sad the way a bad dealer can cloud the reputation of a brand in a particular geographic area. I have a blue tractor and had a bad experience with a certain dealer... I simply quit going there, and do all of my business with another dealer. However, there are other people in this area who won't buy a blue tractor because of their bad experience with the one dealer.
I'm sure the effects of bad customer service like this affects all brands.
