We recently had to send the cops over to talk with the neighbors about there dogs. Dogs were being aggressive to my wife and I and bum rushing us on our property and down the road a ways when we were out walking our dogs. This escalated to the point where my wife went back into the house and got her pistol one morning because she couldn't make it off the front porch area. She had to fire two shots into the flower bed to get the dog to back off so she could get to her jeep.
I talked to the neighbors that night, other neighbors had talked to these people about there dog on previous occasions. Didn't do any good, and when my wife and I went for a walk that night, the dogs bum rushed us again. We waited down the street away from the dog, and had an officer go down to the peoples house to get the dog owner to come out and retrieve there dog.
I explained when the officer arrived what was going on. That I have a valid conceal carry permit, which I gave him as well as my drivers license, and that I was indeed carrying at the time
Officer went down to the owners house, had them corral the the dog. Then explained the the county's dog ordinances that were adopted in 2013. As well as my rights protected under that ordinance. He also explained the fine structure, what he could have been fined for that night. He also explained the fines if his dog actually attacked someone or someone else's animals. The last thing he explained to the guy was that my wife and I are both licensed to carry, are carrying, and if the dog kept coming at us barking and growling after we yelled at it to stop, then we were well within our rights to put it down. He also informed the owner that this was his one and only warning. If he gets another call from anyone on the street about his dog, then the fines would start adding up. Dog owner got the hint and has been very proactive about keeping it in the fenced in portion of there yard
I put down a neighbors dog the year before the county enacted the dog ordinance. I got charged with a misdemeanor cruelty to animals, had to post an $800 bail, spent a couple hours in a holding cell till i got bailed out. I had no idea a warrant was issued for my arrest and got stopped for a headlight that went out on my way to work. Also a mandatory court appearance to plead my case. This was after the dog owner was warned repeatedly, even with a visit from the police with a police report filed. I was able to get it thrown out, and all my money back except for a $20 bond. Had the court room in an uproar when I informed the judge that the dog went after my two year old grandson in our front yard a couple minutes before it was shot. Which was filed with the paperwork for the charges against me. The charges weren't filed or a warrant issued till 6 months after the fact.
At least with the new ordinances, they put the responsibility for the animals behavior onto the owners, and gives people some protection if they have to protect themselves or there animals
