One of my buddy's has a small body shop and his little 8lb. mixed breed dog Buster is the king of that castle. Well, His neighbor, who also works with him in the bodyshop on the side ( he is retired) has a pitbull that is mean as a hornet. It got loose this summer and attacked another neighbors dog and the dogs owner. Well, The Pitbull got out yesterday and attacked Buster. Busters owner treid to pull the pitbull off of him but the pitbull bit him all the way through his hand. so, he got a 2x4 and beat the dog right in the head and it STILL would not let go of poor little buster.

Busters owner got the 12 gauge Mossberg and shot the pitbull. He had to shoot it TWICE !! Not a pretty scene.
My question to the TBNer's is this. Should Busters owner have to pay the medical bills to fix his hand? Buster was not on a leash afterall. He was just walking in on the road in front of the garage and the neighbors house. The pitbulls owner seems a little P.O.'d that he shot his dog but what choice did he have really??? He has not even mentioned payment for anything. I guess he thinks that since he lost the dog they are even.

I hope you are joking.

If Buster's owner sees a lawyer, the pitbull owner is going to be looking at a huge liability suit. Possibly enough to be more than his insurance will cover.

The pitbull owner should offer to pay any and all bills, and pray that Buster's owner doesn't go to a lawyer.

I'm with Dave here. If the guy owns a house or has a job, than he's gonna be in a world of hurt if the guy who was attacked hires a lawyer. Too bad people who are responsible for these things rarely do the right thing and even when it's forced on them, they fight it kicking and screaming.

X3, I agree with the above. If the Pitbull owner had appoligized and offered to pay for all bills, I would say that would be a reasonable outcome. But, since that didnt happen, I say hang the guy out to dry.

On my own personal note, my wife, my dog and I were walking in our subdivision a few months ago and got attacked by a Husky (I know, they arent known to be aggresive) The Husky came after my dog. Long story short, The owner was watching as his dog ran into the street after us, he also got to see me kick the *** out of his dog. He threatened all kinds of law suites against me because his dog came into the road after us. He did come to my house to "visit" me the next day. After a short discussion, he left and of course, I didnt hear anything else about it. It just amazes me how some people are. Its like they have no concept of how to live in a society.

Sad event,but as the others have said its the only right thing to do...hope the town or city where this happen doesn't have tough dog rules like we do...court date & $$'s in fines.

I guess it may vary per state, but in most states the owner is responsible for their dog's actions at all times; on their property and off. Even if the dog is tied up and a child wonders onto the dog owner's property and the dog attacks the child, the dog owner is in trouble.

I know about a lot of this only too well. When I was a child I was viciously attacked by a dog and nearly lost my left leg. The dog broke both my tibia and fibula and cut all five tendons going to my foot. I spent months in a wheelchair and then the better part of a year on crutches with grueling rehab for what seemed like forever. Other than nasty scars, I healed with no permanent disabilities. As a matter of fact, due to the tough rehab and my will to walk again, I became a long distance runner for quite a while.

It was during that running period that I'd encounter dogs running out into the road after me. That was not a good deal. Most owners didn't care and they always said "oh, he won't bite". Yeah, my butt! I even saw several owners watch their dogs chase me from their windows and they did nothing to stop their animal! That is when I got a carry permit and carried when I ran. It took almost 2 years before any big incident happened. One guy had a Chow that enjoyed terrorizing me when I ran past their house. I'd run on the opposite side of the road and try anything I could to stop the dog. The darn owner was usually watching from his window but did nothing. Finally one day the darn dog bit me on the arm when I was walking backwards trying to keep it from chasing me. That was it! I drew my pistol and killed it on the spot.

I love animals and hated to do so, but I felt I had no choice. I mention all this because that idiot that owned that dog not only refused to pay for any medical bills for the 18 stitches in my arm, but tried to sue me for killing his dog! I did go to court, brought 3 witnesses who saw the event, and it was a short day in court. The dog owner lost, his homeowners paid my bills, attorney fees etc., and dropped him. The judge also barred him from owning any other dogs that weighed more than 10 pounds. I know it's definitely not the same, but it is a case where a dog owner had his dog killed after it bit someone and was not willing to apologize nor pay for any medical bills.

I'd suggest your buddy with the small body shop call an attorney. Most any attorney would take his case on a contingency basis, so he won't have to pay up front for any attorney fees. Besides, it sounds like the owner of the pit bull is not responsible enough to own such an animal.

The Pitbull Owner is liable. In a big way.

In NC a dog can be judged dangerous. If the dog is put in that catagory the dog has to be fenced in, signs posted, etc. Of course this puts the OWNER on notice regarding the dog. The origional attack should have been reported. Think of what that dog would have done to a child.

I have NO sympathy for the owner or the dog.

We had an incident in my county where a deputy responded to a burgler alarm call. This is a very nice house that I drive by twice a day. The people own a landscape company. When the deputy got to the house some of the labor tried to tell her not to go near the house but she did not understand since they did not speak English. She drove to the house and when she got out of the car she was attacked by a 3 or 4 pitt bulls. She was tore up pretty badly. Arriving backup officers had to shot the heck out of the dogs. I think they killed one. They other dogs survived somehow.

There was a lawsuit but the settlement was not publicized. It took the deputy months to get back to work.

We have a neighbor that lets the dogs run loose and they have been reported multiple times. One of the dogs likes to chase cars. I use to drive to avoid hitting him but after years of dodging the dog and after seeing his aggression towards my dog and other people, I dont dodge anymore I just drive like I should.

A color photograph of the dog bitten limb with blood, gore, pain, and injury is worth at least $250,000 sitting on any attorney's desk ready to be shown to a jury......no questions asked.

Pitbulls are the favored bread of choice with the meth heads where I live. It's such a problem that my town recently passed stricter visious dog laws that allow the police to distroy pitbulls on the spot if they are involved in an attack.

BTW, when I saw the title to the thread I looked out the window for an angry mob carrying pitchforks and torches!! :eek:
