On my own personal note, my wife, my dog and I were walking in our subdivision a few months ago and got attacked by a Husky (I know, they arent known to be aggresive) The Husky came after my dog. Long story short, The owner was watching as his dog ran into the street after us, he also got to see me kick the $h!t out of his dog. He threatened all kinds of law suites against me because his dog came into the road after us. He did come to my house to "visit" me the next day. After a short discussion, he left and of course, I didnt hear anything else about it. It just amazes me how some people are. Its like they have no concept of how to live in a society.
That's because they don't .

This is bad news - for victims attacked by such dogs.
If the dog owner don't have a PTPI the victim is SOL for compensation.

When we were kids my cousin and I would ride our bicycles in the country.
The dogs would run out of peoples yards and chase us so we started carrying our BB guns on our bikes. We sent many a dog yelping back to the house.

Not having home owners ins coverage is a good way to lose a home over something like that. My dog is a mix (BlackLab, German Shephard) so it doesnt effect me, I just thought it was an odd exclusion of coverage. I wonder if you would be grandfathered in if you already had the dog before they changed the conditions of your coverage.

The home would probably be lost to the bank not the victim.So the victim's still left holding the bag.

If you got sued in these circumstances and your home owner policy specifically didnt cover it - or if it did but not the value of the suit (or judgement once it is settled in court) they would proceed to take assets.
They would force you to sell the home (the bank would collect what they are owed, the balance of the sale would go to the judgement), garnish your paycheck and future earnings, any stocks, business in your name, etc...
...You would be forced into bankruptcy, and fiancially crushed

its possible the victim would gain in this scenerio

I'm certainly not an expert in these legal fields but I thought (here in CA at least) that the home sale couldn't be forced but that a judgement lien could be put on it so that any future sale would have the judgement amount directed to the victim.

Is my thinking incorrect? Or is it different in other states?

No offense, and I'm nit picking, but this drives me up the wall. Are you sure it was a "pit bull"? Most people wouldn't know a pit bull if it bit them (no pun intended).

As an owner of an American Staffshire Terrier (sp?), I find it more than funny how people "catagorize pit bulls".

Posts like this give the breed a bad name, it's not the dog, but the owner.

Yeah, my Sig is really a bad gun.

Oh, by the way, I'd probably shoot that stupid owner as well. Chances are that *** will get another dog and it will have the same "social issues" as far as being "mean".

Needless to say, I would make that "former" owner of the "pit bull" pay through the nose, if not for the issue alone of him being so stupid to let a "mean" dog unsupervised (off his property without a leash).

I picked the Bull Terrier first, then the Pit Bull. Anything looking like either one of them comes on my property acting anything other than extremely docile and it's dead if I have the opportunity. My decision, my prerogative. I'll dust a beagle if acts aggressive toward any of my family, but the dogs that can and do have more tendency toward aggression get very little leeway.

I'm not sure I ever read WHERE the actual contact began. I read that Buster was out on the street in front of the neighbor's, and that the pitbull "got out." But Buster was out too. If the contact actually began on the neighbor's property (owner of the pit bull) I'd say Buster's owner is at fault. I still wouldn't want the pit bull runnning around unrestrained, but that man is entitled (unless local laws say otherwise) to have that dog on his property. If the contact began on public property and both dogs were unrestrained, then I would fault both owners. If Buster never went onto the neighbor's property and the fight started on Buster's owner's property, then the pit bull owner would be liable in my view.

We went through this years ago with a neighbor's chow that was allowed to run. It came over our fence one too many times and our Scotty put it in such shape the vet had to put it down. Yeah, I was shocked too...the Scotty was 1/3 the size of the Chow.
