I would take it apart right on the spot, and then either deliver it in pieces or put the pieces next to the public road and tell the guy where to pickup his Jeep. Sometimes you just have to disassemble something to get it in/out of a tight area if there is no other way. Being the property owner, I think you get to decide what's best.

Don't sound like he is being much of a good neighbor, unless there is some bad blood from the past, meaning your neighbor that won't let the other neighbor retrieve his propane tank.

I have to agree with the others here that you need to hang onto that keep until paid in full. From what you said the jeep isn't going anywhere based on the transmission loosing it's fluid and stopping where it is.

I wouldn't lay a finger on it and would document it's condition from time to time until it is out so as to protect your folks from being accused of any additional damage either done by someone else or by the vehicle recovery.

When calculating your cost, don't forget the environmental damage from the lost oil. That can be in the tens of thousands.

Don't file or even speak to your homeowners insurance company...You premium will go through the roof. The driver is liable, you can attempt to file a claim against his automobile insurance. I would certainly speak to an attorney.

It seems this 21 year old has been quite busy in his short driving career. Yes, there is logic why he would be running and getting rid of the beer. Also, time will tell if he really has any insurance.

This did not happen with the two incidents I described earlier. I reported both of them to my homeowners insurance company (State Farm) and my premium did not go up.

And the only time you'd file a claim is if the driver's insurance company doesn't pay or if he doesn't have insurance.

Could you describe the circumstances of what happened to you and why you decided not to report it to your insurance company?

ruffdog: To state the obvious, you're getting some really bad advice on what to do with the Jeep. Some of it's in jest, but some of it's not. As I, and others, suggested, let the insurance companies deal with it. Document the damage, starting with the Jeep itself, and the entire path to where he first left the public road. I walked the path from where the vehicles left the highway, right to our barn, so it was easy for people to 'relive' the incident and see just how far they traveled and the damage they did.
