Statues is the kioti sent a email said they can't find anything wrong. Then the dealer calls and want to replaces parts. But is told the dealer kioti said there was nothing wrong. One they weren't not allowed to replace anything and only take pictures. Kioti kept lying to to use so my wife is now pissed and is letting AG work on it now. And so far in our research we were sold a 2008 not a 2012 tractor. Which is in a mail from the selling dealer brand new off the line kioti. So we are also going to file a lawsuit against them.

Yes kioti corp emailed saying the dealer tested and it starts fine. One kioti told us in a email they where only taking pictures then telling the dealer to replace parts.
Which the dealer called us because we call them to make share not to touch or replace anything. He infor me they can't start it. But kioti is telling us it runs fine.

And it the sales write up it says 2012 but so far in the dealer who is helping us it is a 2008. As the lawyer say right there we got them. And kioti corp is on the hook not just the dealer that sold it.

As discussed, at length, in other threads on this forum, tractors do not generally have model years in the same way that automobiles do.
Buying a new tractor that has been sitting around for 4 years is probably outside the norm, but is not unheard of. Really what you're getting when you buy a "new" tractor is one with low/no hours on the meter and a full-period warranty. Now, if the dealer had a 4 year-old model with 200 hours on the meter and rolled it back to 4 hours, then you would definitely have something to spit about.

I really think that your best next step would be to have someone with a DK, within driving distance of you, pay you a visit and check out how you're running it and witness the problem you're experiencing. I may be missing something, but I can't shake the feeling that you're doing something wrong, minor as it may be, and it makes the tractor not run as you expect. Then, when the dealer/Kioti has it, they are not doing that same thing, and they can't find a problem. Maybe you're trying to start it in gear, or trying to run the FEL into a pile of dirt at idle, or something simple like that that is just getting lost in translation.

Correct,, but in my opinion if the dealer wrote "2012" on the bill of sale, the buyer could logically assume if was manufactured in 2012 or 2011, the same as automobiles. If the seller wanted to unload a machine made in 2008, he should have left off the year and merely put the model and serial number down. Writing "2012" on the bill of sale would show deception as I see it.

Boats often have motors of a different year, especially on outboards, and the two may or may not match. Again, the year sold determines the year put into service. No recourse on common business practice in an industry. Buyer beware prevails. You want to know what year a boat or tractor were manufactured, refer to the serial number plates on the equipment.

It may take a while, but let the AG handle it thru arbitration. You will need to have everything document thoroughly like the year model being falsely stated, how many trips that you paid for to transport it to the dealer (these can be reimbursed if arbitration judge agrees ) lack of use for the tractor is also reimbursable if unduly long in the shop.
A friend of mine just settled with Ford over the diesel engine in his truck that Ford cant fix. He got reimbursed for non-use, mileage paid for to transport it from Mass. back to Texas because the Ford dealer there wouldn't work on it under warranty, (basically all the expenses he was out for 2 years or more were paid ) plus he has a lifetime warranty on the engine with no deductible and they have to furnish him a loaner each time it goes in the shop for repair. Not a bad deal but he did have to do a lot of research and furnish documents to the Attorney General. He was out any legal expense as the State Lemon Law and the AG takes care of his side of the fight.
I think you should let the AG pursue his Lemon Law. The arbitration court is binding on both parties however so you better have your facts documented well if you intend to win the case. It sounds like your current dealer would be able to help, but you need to get his statement in writing before Kioti is able to pressure him.

Yup. Year of Manufacture in the case of LaK is a red herring. Not "As the lawyer say right there we got them". Very commonplace for a tractor not to be sold the same year as it was built. Its standard procedure. Thats why I asked about delivery hours. Tractor was technically "new".

Did the dealer where it is now say "It starts fine" and tell that to Kioti, who relayed that to you?

Is the dealer where the tractor is now the one who was taking pictures to send to Kioti before replacing parts? That is standard procedure. Alot of companies want pictures before allowing warranty, particularly in a case where there is some conflict with a buyer.

Then it sounds like you called the dealer and told them not to touch anything, although Kioti corp. has authorized some repairs as a result of the pictures.

Can you clarify what the heck is going on, just where the tractor is, and how many dealerships are involved in this repair? It sounds like more than one dealership is involved.

Tractor owners on this forum have tried many times to assist LaK but he never provides any technical information of any substance. All he seems to want is his money back after he has worked that tractor for a year and that's not the same as returning a toaster to Walmart for a refund.

Here when we bought the dealer mailed it was right off the line a brand new 2012. Manufactured in 2012.

When we agreed with kioti to take the tractor it was only to take pictures to start the process to exchange the tractor or give us our money back.

Kiote agreed that they would not fix it repair it that they were just taking pictures and a email they also sent saying that it is in the process to exchange or to give us our money back they promised us they weren't going to try to fix it and then they turn around and tell the dealers a fix it.

Let's be frank it's not operated error it is the tractor I grew up on a farm the first vehicle I drove was a tractor at the age of five I've been running a tractor since the age of five heavy equipment excavators bulldozer everything so stop saying it's the operator error it is the tractor I'm getting sick of this.

I got a lemon plain and simple this dealers getting tired of trying to figure it out they say it's a lemon they're trying to help me move forward kioti was lying to them and lying to us trying to cover their *** trying to get it so we don't go to the Atty. Gen.

You can't even drive it down the road without it shutting down if you hit a little bump and the tractor dies out so is that operator error I don't think so it is the tractor error it is this company who puts crap the parts in.




I'm done talking about the tractor right now I got enough stuff going on my grandfathers in the VA hospital in Vermont dying I am not in the mood to be dealing with tractor right now


Plain simple the dealer that's been working on it right now says they can't guaranteed if they drop it off that won't die out why should I keep on bringing it back and forth to the dealer.

Kioti corporate said at the dealer tested it for five hours and they couldn't see a problem with that starting but then we get a call from the dealer saying is it alright if we replace some parts because it won't turn over but kioti is emailing us it runs fine. And they're calling my wife to her runs fine. and then my wife says oh no it's not because the dealer just told us they need replace parts because it's not turning over so you just lie to us .
