In our state, if you bring groceries home for your mother in a vehicle or combo vehicle (truck& trailer) that has an actual weight of 10,001 or more pounds and your own mother gives you a cookie you are commercial. Any form of revenue or enrichment. So, mowing your field on hunting property up north increases value -> bingo you're commercial because you hauled it up there and back!

I use these extreme examples as I asked the local highway patrol these exact questions to determine the level of the insanity.

(Not that 99% of the guys / gals would enforce it for your mom giving you a cookie, but they COULD under the LAW. If that doesn't scare the snit out of you, I don't know what would!)

There is some level of insanity in those who would work for a system and claim that they can do this type of thing. They are essentially telling you that they can abuse you within the system. The system must be tempered by good sense at the origin so that freedom is not threatened by a reliance on winks from authority.

The other aspect of this is that it is an often overlooked example of how free markets are NOT free markets. In other words, you hear organizations like Walmart, etc invoking their right to exploit free markets and you hear half wits like Rush Limbuagh defending Walmart's and Exxon's right to a free market. What he, and many others, don't realize is that this very type of legislation FAVORS the big players over small business. Corporate organizations like these have ready access to capitol which makes regulations like this inconsequential to their bottom line, knowing all the while that it stifles the local competition. That, my friends, is NOT a free market. That's a deck stacked in favor of the big guy at the hands of your federal, state and local governments who are supposed to be there to keep the playing field level for everyone. Which means, for the small business man, your tax dollars are being used against you. Feel betrayed? You should.

There comes a time when the interests of the government are so intwined with corporate entities that you can't tell the players without a program.

Ooooooohhhhhh, politics, what a timely topic :D

I think we'd be very shocked at what laws lurk in the dusty volumes in our respective states.
On 1st glance the thought came to me that the enterprising law enforcement officer that took time off from protecting us from the more dangerous segments of our open society such as murderers, gang bangers, rampant open illegal drug dealers etc., to ticket a an individual because his non-violent tractor apparantly didn't have a VERY little known licence tag, just may be a competitor or related to one......

At this time in the great state of Tennessee we don't have a state income tax nor a personal property tax but we do have a tax on investment income (Hall tax) and state and local sales tax that'll danged near get us to help chuck some tea overboard. Course tea, the iced and sweetened kind is kind of a staple at meal time down here so I best modify that last sentence to say that we'd probably float around and pick up the tea that y'all toss :D

Before I get too far in the mess we're gonna face come Nov, I don't think we have the tax that somehow materialized on Lonecowboy but it wouldn't surprise me if we did......

Maybe if they tax the illegal drug dealers, hummmmm.....

Shhh. The 'P' word is not allowed here. I was talking about, uhm, err.........economics, yea that's it, economics, not the 'P' word. Of course, now the TBN admins may need to modify the Terms of Use to include the 'E' word (ecomonics) as well.:D

LoneCowboy's dilemma is coming up in the same state where it is illegal to put a rain barrel on your home's downspout. That's right, you do not have the right to the water that falls on your roof in Colorado.

This came up on LawnSite in a discussion of rainwater harvesting, rain barrels and cisterns.

Are you kidding me? I've never heard anything so asinine.

The easy way around it of course is to bury your downspouts to get the water away from your foundation, as many inspectors recommend, but just have a dummy outlet and the real pipe go into your cistern....
