Aaron, what I was attempting to imply was that it must be a pretty small downpayment, and not worth the headaches of a lawyer/legal process. You're right, what I should have said was something like, 'if it's anything near the value of a trailer..' Sorry for the confusion there.

interesting thread. forget the trailer and stuff on it. whats the current story of finding a new contractor? last i see the OP got info on his old contractor of money issues from his lawyer and he seems to be in the best shape compared to others who contracted with his contractor.

So if he is moving on, did he check with town yet on the permit if it was issued ? is it expired or can it be transfered to his neew contractor? since its october now, will he be able to get a building up before winter starts or need to wait another year ?

hello??? trailer loaded full of materials that he could lein / possible legally seize once a judge waves his magic wand.... did you read the entire thread... lots of stuff burried here..

No one thought about 2 possible issues (1) the trailer may or may NOT be owned by the
contractor. It maybe borrowed or may have a bank loan on it.

(2) If the materials on the trailer weren't paid for at the contractor's supplier, but "put on account," then they STILL belong Lowes, HomeDepot, etc.

The OP stated that his jurisdiction has statute that allows the transfer of ownership of abandoned property. Even if the builder did not own the trailer and put the materials on an account, they were in his possesion and control and thus subject to abandonment. Unless the title or lien holder shows up to claim the property before the deadline, he would still be able to claim the property.
