Get a lawyer now and have him hire the new surveyor and all the other involved details such as cost for moving any structures and returning the soil to what it was. It will become part of the settlement and all that would most likely be paid by the surveyor's insurance.

Bought about 7.75 acres back in 1973
In 1982 I had it surveyed into about 6 lots and sold them off to a developer.
Kept getting a tax bill for taxes on about .25 acres for years after the sale.
Only problem is there was no such piece of land as it simply did not exist because I'd sold it all.
I never did pay the taxes.
Let them foreclose on it and get their money out of it that way.
2*There was a conflict between the original survey I had done in 1973 and the survey I had done in 1982 for the subdividing.
The county tax auditor must have given up on collecting the tax on the non existent land
because it's been a few years since I've gotten a tax bill on it from them.

I have contacted several lawyers that our association has dealt with. I will be interviewing them tomorow and will have one engaged by then.

The surveyor said the reason the field crew didn't catch it was the length of the two lines was within a couple hundredths of a foot over 633 feet, so they assumed it was the right mark. They never re-checked it on the second survey, they just went off of their stakes in the ground from the first survey.

So far, the new owner, who still isn't in town, has said he has no plans for that area and he isn't concerned, yet...

Is it really Adverse Possession if you believed the property to by yours?

My understanding is that it has to be open, hostile, notorious and you paid the taxes... looks like you've got all counts covered except for hostile...

A question for the Lawyers I guess...

if they have an adverse possession law, and they both meet the requirements, the "believed property lines" become the property lines: so neither loses anything.
