I do not know what other options I have. My tractor has been out of service for 10 of the last 12 months. Today is October 29,2015 and still no tractor and no idea of when it might get back here. It has been gone since May this time except for 4 days when it was returned not fixed and they came back and got it in August. At least 2 complete hydro's have been installed and it still is not working correctly. If anyone has some ideas I am all ears. I have contacted Kioti Corp. and the dealership many times with zero results so far. Not only have I not had my tractor but I have lost almost 1/4 of my warranty as well. Winter is just around the corner for here and I need to keep my road/yard open or I have to hire someone to do it. The have put on a bunch of hrs. as well "testing" it which are hrs. I can not utilize.

Again if someone knows of some options I sure would like to hear them.

Who were you quoting at the beginning of this post? It's not clear since you only have the text and no poster info?
You say you've contacted Kioti and your dealer many times with zero results. You also say they've replaced at least two hydros. It would seem someone is doing something if at least 2 hydros have been replaced!?
It is difficult to know which tractor you're referring to, since the info on your issues has been removed from viewing for many of us. Which tractor, how many hours on it; who's working on it? How have you contacted Kioti Corp.; by email, phone, letter, smoke signals, what? Have you spoken to or contacted the zone representative for your area in which you reside?
If you haven't been in correspondence in writing, with a zone rep at this point you will need to do so to escalate the situation until someone who makes decisions about unsolved issues is in charge of your case. He was quoting me. I will repeat my advice, make the call to MIE and see what they say, it can only help. Otherwise, sell and get another tractor, it will be cheaper and quicker than suing. Pick up the phone and try to get through to Kioti or a good dealer.

Exactly. There have been cases where a dealer or mfg has requested that a thread be removed, generally because it falsely paints them in a bad light or because there was more to the story.

But they can do it if its correctly painting them in a bad light too. ... Sure theres two sides. But one of them is heavily invested financially and compounded by being at the mercy of the other.
......... All while not having what they paid for.

I responded going on the assumption the tractor is still under warranty, has experienced repeated failure of the same component and has been out of service for 10 months in the custody of an authorized dealer...

The tractor is under warranty has been at the same dealer for 10 months and out of service. I have called, emailed, both Kioti Corporate and the dealership many times. I do not know how to contact the Kioti rep for my area. I have been in contact with the dealership the most but also with Kioti Corp customer service. I have not kept a written record because when this all started I had zero clue it would turn into this so I am going by memory not exact dates but I am close on the dates. I was able to get a copy of the service record of my tractor DK50SE HST CAB which is the one with the problems. Kioti Corp refused to give me the service record as she said it contained privy information. I think the service record is NOT complete as the old service manager at the dealership is not employed there anymore he did not keep my service record updated. I bought the tractor in August 2012 and before delivery service work was done by the dealership at point of purchase. The hydro problems started in 2014 and so far have not been resolved. The last time I knew the hours the tractor had 234 hrs on it.

I thought it was out of warranty. Take it to the dealer and leave it there. Tell them to fix, test it, fix it again if necessary. You can't use it anyway, so get the dealer on it. This is Kioti's problem, not yours. Service record doesn't matter, this is why you have a warranty. And, if Kioti refuses to honor the warranty, then the AG will definitely be interested, and will probably get going a lot faster. This is a Kioti problem, get them on it, or threaten legal action. It's amazing how fast that will get a response, especially if they know they're in the wrong. I had to just threaten legal action once, and all the problems cleared up. You have leverage, use it.

Good reply TRW, now maybe we can get somewhere on this issue. I suggest calling the dealership who has the DK-50 and ask for the contact name and number of the zone representative for your area. From this point forward keep records of everything and person you speak to and when. Let the dealer know, politely, that you are noting everything that you're told by them for the record. I'd also ask for the dealer principal and speak to him/her about what exactly is going on with your tractor and your concerns about needing it right away for obvious reasons. See what they say. Report back here, but leave out names, of the specific people involved.
For clarity, the tractor is how far from where you live? Is it in the same state where you reside? And the other Kioti tractor you own- what is it's situation, briefly?

My DK50 is the tractor with the problems. The other tractor is a DK35 which I owned when I lived in Canada. I was told last Wednesday my tractor would be back at my house today which is Friday. Tractor is not here zero communication from the dealer which is normal. The tractor is in Wisconsin where everything except the first service work has been done. It is about 250 miles from where I live one way. I have spoke with the dealership's head person more than once who basically passed the buck and had me talk to the service manager. I will try to get the area rep's info and contact asap. The service manager told me on Wednesday if this last hydro does not fix the tractor they are refusing to work on it anymore and the area rep told the service manager Kioti will give me a new unit. None of this is writing only in a phone conversation. That would be great as I have no faith for the future of this tractor.

Wow, what a mess. :confused2: Whatever you're told by the Wisconsin dealer needs to be verified in writing, for sure. Ask them tomorrow to provide you the zone rep's info right away, including his email address, phone #, etc.
By last hydro, are we talking second replacement, new hydro transmission, both installed by this Wisconsin dealer?
I'd want the dealer's head person AND the service manager's email address too, right away. All correspondence with them ought to be by email, with delivery and read receipts requested on everything you send them. Email is inescapable, and one of the best ways to track progress and who said what when.
I would definitely ask them, in an email; "Am I to understand that if this latest hydro replacement does not resolve the issues with my tractor, you've said the area's zone rep has told you that Kioti would be replacing this tractor with a completely new one, correct?" (something to the effect of what I put in quotes, just above....
Keep up the pressure, this will keep everyone on their toes. Way too much time has passed, and you deserve immediate resolution to this nightmare.
I'm with you all the way to the end. :thumbsup: Don't loose faith, you're closer than you think to a satisfactory outcome.:)
