OK, what's going on here? Hundreds of times we've all talked about our "rights"... but what about the responsibilities that accompany them?

Yes I'm sure it's a PITA to assist the LEOs who are responsible for enforcing the laws. Yet if we don't help them enforce the laws which allow us to live the way we do, how can we expect those same to protect us?

My 'testimony' would have been of no use.

I did not see a face ont he person walking, making noise. And I don't know the person arrested.

I can not make an ID based on that lack of info.

would YOU want to be convicted on that 'evidence'? I sure wouldn't.

the extent of what I knew was that SOMEONE was making noise. and then after the fact.. the officer told me he arrsted somebody.

Yes, I read every post. You were apparenty honest and straightforward with the court system about what you saw. IF you were actually to appear in court, I hope you would do the same. I'm sure it's been a PITA, but s**t happens. If you were accused of something, wouldn't you want to know that all the t's were crossed and the i's were dotted?

Oh, wait- bad analogy... I doubt you will ever allow yourself to be in that situation. (meant as a compliment.)

Having been to court myself as a witness on behalf of my employer, I can say that's probably the best advice anyone's given on this thread yet... No guessing. For others who are ever faced with a similar situation I'll add keep your answers short and don't volunteer any information. Just answer the questions.

yep.. the no guessing part is important. While I my think and be 90% sure the guy I hear making noise, was the guy walking, and was the guy that got arrested. i can't match a face tot he warm body.. and thus can not say 100% that they are all 3 the same.. to say so would be the injustice inthe case.. vs the 'disturbing the peace' charge..e tc.

Sometimes, you have to piece a case together with witnesses A, B, C and D. The problem in this case is you apparently feel that you didn't get a good enough look to identify the person which makes it difficult to piece the case together with testimony from multiple witnesses.

It would be a different story if you and the other witnesses each knew the person so the testimonies from each of you would all make sense as a whole. Unfortunately, I think the DA can't tell you the whole story without compromising your testimony.

In some cases, the prosecution just can't piece the case together well enough to make it stick.

Our justice system works best when we do our duty as citizens of the government and comply with the citations and subpoenas served for either jury duty or as a witness. It also is best to exercise your right to vote in the polling of our local and national governmental elections. Inconvienent perhaps, but necessary. While you may not be able to identify the man, you certainly can tell about what you did see and hear, as well as to the time and where it occured. Sometimes, these matters are at issue. While I do not like to get involved in my neighbors' matters any more than you, I would expect and hope that all witnesses, good and true, would come to the courtroom and share their perception of what they beleive they saw, heard, felt, touched, and when and where that occured.
