As to the op if they are in your fence line I think you are within your rights. Don’t be going to the neighbors and cranking off a round.

If somebody comes on my property and starts shooting at my dog, I might feel that my life was endangered and act accordingly.

I hear ya BUT you don't need to be posting on the internet or telling anyone what your intentions are. That could come back to bite you should they get a lawyer.

In my state you are allowed to protect your livestock, but you need to be able to back it up because it you get it wrong you are facing a class 4 felony charge or conviction which will prevent you from owning firearms for life.

Even in the Democratic Peopl'es Republic of Massachusetts, dogs worrying livestock can be shot.

Florida Law:

767.03. Good defense for killing dog

In any action for damages or of a criminal prosecution against any person for killing or injuring a dog, satisfactory proof that said dog had been or was killing any animal included in the definitions of "domestic animal" and "livestock" as provided by s. 585.01 shall constitute a good defense to either of such actions.

767.01. Dog owner's liability for damages to persons, domestic animals, or livestock

Owners of dogs shall be liable for any damage done by their dogs to a person or to any animal included in the definitions of "domestic animal" and "livestock" as provided by s. 585.01.

No, the sad part is even though it's written in law in Massachusetts, the issue becomes if you use a gun for self defense, there is a good chance the peoples republic will try and take your gun away under some anti gun law. The other sad part is if it's just you and your animals, exactly how does anyone find out that you shot something?

I wonder sometimes how many people on this forum leave their dogs outside unattended, free to roam?


We do but, we're at the end of the road and nearest neighbor is about 3/4 mile down said road. Our dogs roam about 1,000 feet from the house (into the field to do their business)....

and to be more accurate, today, they're all about 14/15 years old (three dogs) and we're lucky to get them off the front porch at this stage.

Just yesterday, my wife called to me....went in to look.... she had taken some pictures. Here's the deer that was standing in our yard and a picture of Otis who was out there as well....deciding he wasn't going to chase the deer.

So we're one of those who let our dogs out but they're home-bodies, not roamers or chasers.

Ah, but in his mind he's chasing that deer just like his ancestors... he's just to wise to waste the energy. ;)
