Well to answer the question as to why my BIL is smarter than his BIL (me).
Its because he lived with my wife 20 years longer than I have and had the benefit of her teaching .

I would think that is the case in most families

Simply because you will no longer have any choice as there will be no Red Dye Off Road fuel available anymore, only ULSD will be available for On Road and Off Road.

What will you do then, add some elemental sulfur and some red dye for nostalgic effect?

It will be, for all of us, as it is for you now; the same stuff only called different names. i.e. On road--no dye. Off road--dyed. Furnace oil -- dyed, but all ULSD regardless of whether or not it is dyed.

Makes sense to me.
I never could see the object of having a half dozen concoctions when one would do everything anyway.

you seem to think that if there's a 40 cent tax difference between on and off road diesel this price difference should be reflected in the retail price.

You are missing their point. The dealer is buying 2 different products, priced differently, BEFORE taxes. If the dealer is paying less for On Road than Off Road, then when he adds the tax for On Road it is only slightly more than the Off Road price. In that case the consumer will not see a price difference equal to the tax difference.
The dealer is not getting volume discounts for Off Raod since he sells so little of it. Pays more for the product but doesn't add tax so it still equals a slightly better deal for the consumer. If you have a dealer who sells a lot of Off Road, then you will see a greater difference in price.
