I really don't know. I have no idea how the courts are going to handle this.

One of the neighbors here decided he wasn't going to pay his bill of about $3200. I waited about 18 months and started court proceedings to put a lien on his land. Statute of limitations is 24 month's. I added interest for each month I had waited and so the total was about $3700. The judge agreed with me and put a lien on his land. My cost was about $750.

I can go to court again to collect for about the same money. For me the issue wasn't the money. It was the fact that they had both looked me in the eye and said they would pay.

Right now I'm just leaving it alone. I get paid about .05% interest/year on the money and if my kids eventually get the settlement at least they got something from me. I don't expect the neighbour will be selling his land anytime soon.

Ahh, but you will get paid because that land is non-transferrable without the claim against it being discharged by you releasing it for the payment. You hold all the cards and they just haven't figured it out yet. You should be able to add in your collection costs and attorney fees.

People do this in small claims court all the time.

Exactly! My last attorney (now a judge) was $300.00 an hour.
