How can it be a civil matter?:confused2::confused2: She trespassed onto my property, and then destroyed my property. If that's not criminal, I don't know what is.

I know.. But her paying for the damage and you collecting that payment is a civil matter.

Few years ago a judge told the neighbor lady to pay court cost first. $900.00



I may have already asked this but can't you get a lien on her property for the amount owed? Then who cares what happens because you will--100%--collect.
I really don't know. I have no idea how the courts are going to handle this.:confused:

If she still owns the land she can't be broke. The court should be able to put a lien on the land if nothing else and should get interest. Your lawyer became a judge but you still should be able to get advice from him or another lawyer on the best way to force the issue without having them show up in court. This woman is milking the system and it has to stop.

Dude.. so what? Let her file bankruptcy.. Do you not pay what you owe, especially through mallice, just 'cause you 'are broke'? If she has that kind of financial hardship, let her file it with the court, then file for bankruptcy. If she doesnt do those, then she needs to pay up for the damages. Period.

Dude...can't get money from someone who has none.

You can't go to jail for being broke and unable to pay and the judge knows this.

If you don't pay a ticket or your court costs, you will most definitely go to jail. The county doesn't care if you're broke or not.

Any willful damage to others property over $1000.00 is a felony in Wyoming. What was she charged with, a misdemeanor?

One of the neighbors here decided he wasn't going to pay his bill of about $3200. I waited about 18 months and started court proceedings to put a lien on his land. Statute of limitations is 24 month's. I added interest for each month I had waited and so the total was about $3700. The judge agreed with me and put a lien on his land. My cost was about $750.

I can go to court again to collect for about the same money. For me the issue wasn't the money. It was the fact that they had both looked me in the eye and said they would pay.

Right now I'm just leaving it alone. I get paid about .05% interest/year on the money and if my kids eventually get the settlement at least they got something from me. I don't expect the neighbour will be selling his land anytime soon.

SA's making the best of a bad situation by keeping her in the eye of the court and not sending himself to the poor house doing it. And in the mean time, we get to see our "legal system" in action. Note I didn't say "justice system", because justice isn't even on the radar.

It is one thing to obtain a judgment for damages and another thing to execute and collect on said judgment as this saga has proven!

Ahh, but you will get paid because that land is non-transferrable without the claim against it being discharged by you releasing it for the payment. You hold all the cards and they just haven't figured it out yet. You should be able to add in your collection costs and attorney fees.

People do this in small claims court all the time.

Exactly! My last attorney (now a judge) was $300.00 an hour.
