That's why EVERYTHING needs to be in writing dealer with snakes. I ordered a popular vehicle once and made it quite clear I would not accept it with more than 5 miles on it. I made a sign and gave it to the salesman to be placed on the dash upon arrival. DO NOT DRIVE,. Everything went well and I was under 5 miles for that vehicle, As I was also there hour after delivery for inspection.
19 hours is WAY WAY too many hours. I would call the dealer and say come pick it up or give you a HUGE DEMO DISCOUNT.

What I don't get is why Steve is allowing them to pass off the very likely well-used loader on his guaran-dam-teed (now) to be new tractor?

I have seen some dealers that don't put loaders on until the tractor sales. Maybe his dealer received the tractor without a loader and put on one that was actually new? That was what I thought when he mentioned keeping the same loader anyway.

What probably happened here is that the local dealer found the tractor in question when he did an inventory search looking for a 3320 for his customer. He would have called to verify that they did in fact have it and arranged for shipping. I'm willing to bet the number on the hourmeter wasn't even mentioned in the discussion, just that the tractor was "new". Dealers don't get too concerned about model years unless there's a significant difference from one to another. This is simply a case of a buyer not being comfortable with so many hours on the clock before he took possession. That's fine, I wouldn't be happy about it either, especially the 6 hours it spent idling and not moving. That's typical of machinery being warmed up and shifted around for snow clearing, or use as a demo., dragging an arena, etc. I'd say the op should get a new tractor, which he is, and an apology from the sales people that the machine they provided didn't meet his expectations. Other than that, it's business as usual. I suspect the next time they get a tractor transferred from another dealer they'll ask how many hours it has, though. Now they'll have it in their inventory, sans loader. Whispered conversations, conspiracy?? Really? I doubt anyone at the selling dealer even looked at the hourmeter, they have enough to do without making more work for themselves. 90 % of buyers wouldn't think twice about it, just some of us, me included, are a little more **** than the rest. A voice of reason amongst all the wolves. Most posters seem to want the salesman, the dealer, their kids, and grand kids tarred, feathered, and run out of town on a rail. They made a mistake. Treat them with respect (which it sounds like the OP is) and they will take care of the problem (NEW, new tractor already ordered).

Why get everyone's blood pressure up, no one is trying to pull anything here. Just like Sean mentions, they probably got the tractor from another dealer that had used it for a few things, but never sold it. It got sent to this dealer, and they had their prep guy put the loader on it and get it ready. He doesn't know what agreement the sales guy made, so wouldn't be concerned that a few hours are on the machine.

Don't get me wrong, the salesperson should have caught it before the customer took delivery. Look at it this way, the OP is getting free use of a tractor while waiting for his new one to come in. Wouldn't we all want that?

Totally agree. They corrected the issue immediately and compensated with the free use temporarily until the new one arrives. If they throw anything else in like filter....bonus, if they don't , don't sweat it.

With that said,

they did not correct the situation immediately as indicated by yelbike. They only corrected after being caught.

They DID try to pull something here, unlike raheimdal's mention of not trying to. And getting free use of a tractor while waiting is NOT anything resembling compensation. And NO, I wouldn't want that, shouldn't need that.

Lastly, if this is "business as usual" as indicated by Chilly, a different dealer needs to be found. Nothing about this transaction is business as usual. It's deception in the highest form and they got caught.

But,,,, sticking by the OP,,,, if he's happy, I'm happy. :)

I think you guys missed the fact that the tractor was 3 model years older than he ordered? I don't think the dealer missed that on accident.

I think the fact that there were so many hours, and it was a few model years older, shows it was an accident. You have to figure that a customer is going to catch that and ask what is up. I'd be more likely to believe it was on purpose if someone ordered a 2014 and got a 2013. Something like that maybe the average person might miss. In this case there is no reason to try to pass the tractor off as new. I think the OP would have mentioned it if the dealer started making excuses when this was brought to their attention, but instead they said to keep the tractor until the new one comes in.

The dealer was embarrassed, and rightfully so.

I'm not buying that as an accident. A dealer is in business because they know all about tractors and know all about tractors because they are in the business. In my view, a dealer that would behave this way is obvious, shameful and desperate. What a dealer does is sell tractors and that business has an accepted protocol of what is expected by what has happened in the past. Who would order a new car and be happy with a faded 2010 and mileage on it?

Yeah, the buyer should have caught it and belatedly did. I'd say a dealer that does this is making good mostly because they got caught and have a valuable franchise that would frown on such behavior. Just my two cents here.

The reason for the dealer was doing it was that they would make several thousand dollars more on the deal. As for owning up to it, they got caught. They had no other choice than to own up to it.
