Several years ago an engineer at one of the big modem makers (US Robotics, Hayes, or ???) said the theoretical maximum on a modem was 33K bps. Then somebody figured out that if you jack up the voltage a little bit at the CO, you could get a theoretical 56. That's what begat the 56K modems. It does require updated equipment at the CO, and the wires to be in "good shape" to actually achieve something close to 50K though.
Just read about a new modem standard V92. Supposed to bump up the 56K to (something) higher still. Probably will require further tweaking of the CO. /w3tcompact/icons/frown.gif
