Most of the laws posted here are vehicle laws and specifically state "on the highway".

While that may cover 'ditch markers', these laws still might not pertain to usage on private property (which is often where mailbox posts are located).

Actually, mailboxes are generally located in the right of way which is considered part of the highway. That is why the highway department can tell you to replace your railroad tie mailbox post with a 4x4.

Agree with Aaron. It's a creative argument, though. A closer question would be where the SMV emblem marking the driveway is set back enough to be off the right of way, but is still clearly visible from the road, as at a bend where the headlights catch it full on just before the road curves. Under the Virginia statute (cited above), I think the sheriff could still write a summons.

One article I read said you were to remove or cover any SMV emblem on equipment used or parked where it could be seen from the road.

I think that's crazy.
