When I bought my 7K trailer in Missouri about seven years ago it had no brakes and I am sure there are a lot of trailers running around without them. That seems strange because I think by law they're required but I guess it depends on how they're enforced. I've noticed the truck inspectors are focusing more on pickup/trailer combos. I did add brakes to mine with the break-away switch.

My book shows that brakes and a brake-away is not required in MO. Kentucky also does not require brakes and I am sure there are other states that do not but those are the ones around me I am familiar with.

Quick check in the area and Kansas does not require them, either does Wyoming but North Dakota requires brakes on all trailers.

Like you said this is not really enforced.

Any trailer over 2,000# GVWR must have brakes and a brake-away system.

I don't remember the break point, but a 7000# plus gvw requires brakes on all wheels in Colorado. It may be as low as 3500#.

No requirement for all wheels in Colorado but brakes are required at 3,000# and above. I actually do not know of any state that requires brakes on all axles. All the law says is must have brakes and that the brake away system must hold the brakes for 15 minutes.

I just purchased a 4ton Hudson equipment trailer and I live in Maine. All dealers I visited while shopping told me that any trailer of 3000 or more GVWR must have brakes and on all axles.

My book shows that in Maine it must have brakes if over 3,000#. Nothing again about all axles but its just a guide, not the bible. I have the number for all states administrator if you would like to give them a call.

Two thing that kills me looking through Maine's rules is a max 45 MPH speed limit pulling trailers and a brake-away system is not required. I bet the speed one is broken every 5 seconds. Also if you are going to put brakes on why not make a brake-away mandatory???
