It would not pay to catch someone like that in the process, cause id prolly end up sued or in jail, due to the sorry nature of courts not allowing you to hardly protect your property or stuff, and sticking up for the guy doing the ILLEGAL activity on YOUR property.

Oh there have also been times where I park half on the old discontinued road making it a bit tough to get by, after all it is my property and I pay taxes on it! I have calmed down over the years and if we see two or three unkown cars a month it is a high number, but I still get a bit upset over it.

I like the parking idea. What's so bad about a parking ticket...that's about the worst they could do to you. Buy the biggest huge old truck you can find and park it smack in the middle of the road with the hood up. Claim, "It just broke down." if someone complains.

I can't disagree with your sentiments here, however, what I, and probably others, need to remember is, there's a HUGE difference between stealing and destroying "things" and hurting or killing "people". Even though we feel like doing a thief harm because of their invasion and disrespect, if it's only stuff they are taking or wrecking, hurting or killing someone over it simply isn't right.

Well, this past year we have a fellow named Ward Bird that held out his pistol to get someone to leave his property and is now serving 3 - 6 years in Prison for his actions. He was convected of criminal threatening and the state supreme court up held the ruling. I am sure there is more to the story than he just held up his gun to the woman, but really she was lost and way off from the town maintained roadways.

Bottom line is I guess, be careful on how you handle those trespassers and also what you say to them, courts are not overly protective of land owners.

Earlier this year in Colorado we had a case where a homeowner confronted a Sheriff's Deputy and 2 Social Service workers who came on his posted "No Trespassing" property. He was armed with a shotgun and ordered them to leave. They did but he was later arrested for and charged with one count of felony assault on a police officer and two county of felony menacing on the two social services case workers.

He was later acquitted on all charges! The Judge says that even Law Enforcement MUST obey No Trespassing signs. A very interesting case to say the least. Read more about it here - Rural Justice (read from the bottom up)

If it's not paved, why don't you just make it really, really bumpy?

I maybe got carried away with the road issue in this posting, mainly I was pointing out to be careful with what one thinks is his or her rights.

As for the road it is basically the same way it was when we bought the property and will remain that way as long as I own both sides of the land it runs through.

I for one always felt you had a right to protect your property, after all we do live in "Live Free or Die" New Hampshire. But, the fact of the matter is there are laws and everyone has to live within them.

We purchased land on a discontinued road....

:confused: I thought Vermont was the only state engaged in the "ancient roads" idiocy.

I thought that when a road was officially discontinued, it no longer existed. If the road no longer exists, the old roadbed then reverts to private property, and anyone who traverses it is trespassing.

I'm with beppington... make that "road" look like the surface of the moon! :D
