So my dk40 se hst still won't start and they replaced everything and dies out digging in sand. I call the dealer that has been working on it. He is calling kioti about it being lemon that we gave them more times to fix it he is going to try to get kioti to exchange the tractor with a new a even trade. He also told me to send the paper work to the attorney general . It will help put a fire under there butt. I had our pastor and my father inlaw there when it died and would start. We where trying to get what could for dead dry wood to help this war vet but with a tractor that keeps dieing out its hard to do.

This has gone on long enough . That tractor needs to go away and so does that dealer . You deserve a full refund , and compensation for your efforts to help others . I would like to see you having some better days . Kevin .

One of the issues is that the dealer he bought the tractor from won't have anything to do with him since that dealer dropped the tractor off. It is another dealer who is stepping up to the plate and trying to help him out and has bent over backwards trying to help him.

Yeah really, I don't see what is so funny about it. At a minimum I would expect a new tractor but by the time I got done with them they would cheerfully give me a Full refund. What good has this tractor been to LAK? How much of a headache has it been for him? Would you want another one if you had as much trouble with it as he had?

The FUNNY part is your orginal comment I WOULD WANT A FULL REFUND which will not happen,I bet money on that.Now you say at a minimum I would expect a NEW TRACTOR?Now that might happen?To answer your question YES I would want a new tractor but rest assured I am pretty sure Kioti is NOT going to give him a FULL MONEY refund as you suggested in your FIRST POST.coobie.

If it were your Tractor it would be a Kubota with Zero problems and running all by itself. :D Well close anyway.

Getting a refund on a lemon isn't unheard of. It happens... ..and it's cheaper for the manufacturer than going to court to fight lemon laws... All it takes is your refusal of any other forms of compensation and lots of calls to the right people... The dealer suggested the state attorney general which is a good place to start. Remember, the squeaky wheel gets the grease...

Actually, given more thought on it. Since the original dealer bailed on him and the same problem has been such an issue for so long; I'd most certainly expect the company to classify it as a lemon, as well as my money refunded. Kioti can refund the money and then go back on the dealer that left OP high and dry (walking away with 'money for nothing' in the process). OP can then take his money to this dealer who has been so helpful to him and let some honest folk earn their living...

Only way I'd let Kioti replace the tractor is if it was coming off the helpful dealer's lot and he was making what he would on any MSRP sale.

I'd also make sure Kioti knew the only reason I was continuing to do business with them is because of this helpful dealer and ensure they appreciated all this dealer has done to prove them to be an excellent company to do business with, and that if it was left to the opinions formed over the dealer that sold the "junk unit", you'd think the whole corporation was junk. Kioti makes a good unit and they don't want bad dealers bringing down their rep any more than any other company. It's unfortunate, but bad dealers have left stains on all brands in various regions.

I think as long as you "squeak" loud enough you'll get whatever satisfaction you desire, they're a great up-and-comer in this segment and happy customers are too good for the bottom line even when they need to lose a dollar or two on the occasional customer to keep them happy.

It depends how deep your pockets are and how long your in court.Refunds are not automatic just because people threaten lawsuits squeaky wheel or not.It takes time and lots of money.

The tractor in question was bought in NJ, shipped to VT/ME? and then stayed in ME for a long time. The selling dealer did NOT make the tractor, they sold it from Kioti inventory and have had nothing to do with it since.
To satisfy the owner it will take Kioti Corp. to decide whether to exchange it for another tractor- possible, but unlikely. The possibility of a full refund is highly unlikely, regardless of any posturing by people here on TBN. A successful lawsuit would likely have to be brought against Kioti and the key word is successful.
The only thing I'd ever bet on here is customer satisfaction is likely a LONG way off. JMHO.

Wasn't a sympathetic dealer trying to diagnose? Does anyone have any idea as to what is expected to be the root cause of problems with this tractor?
