Open space, near tract housing..... explains a lot. Though, idiots on loud machinery are a problem everywhere...

We all seem to agree, more legal directive/action needs to come from the estate, for a few reasons. Video works well today.... a few minutes showing the illegal activity might get the executor interested in responding, once they understand the liability better. You don't seem to mind donating your time, work, and some $ to solve this, but once you are in closer contact with the executor, I'd strongly recommend that you submit bills for at least the materials you are using.

Once they understand the situation, it would be hard to imagine a sane executor balking at a minor bill for sign or short-run fencing material. I've been an executor for an elderly relative's estate. The executor should want the bill in their possession to demonstrate that they had put effort into posting the property, and attempting to control access. IMO, you want that paid bill in your possession to clearly demonstrate that you had approval and direction from the estate.

Years ago, the Ontario city I grew up in had a similar problem with new developments on the west end of the city. ATVs weren't really in the market, back then it was motocross bikes tearing things up. Hard to catch 'em, even back then. Smart police captain asked for his guys that were interested, and sponsored them on the provincial motocross circuit (still, today, I think that was a good use of tax dollars.....) they got fast enough that they could catch virtually all the (mostly) kids messing about on these construction sites.

Most forces don't want to get that involved in chasing ATVs these days (until something high profile happens anyway......), the last enforcement action I heard about around here concerned UTVs, but that's a different story.....

Been a while...... the last time I got a hold of our HTA legislation, it required that ATVs had to be plated and insured, most of the time - the exclusion was if the ATV was only used on land that you own and reside on - mostly an Ag exemption was my interpretation.

Don't know if your traffic act legislation details are similar or not, but might be worth checking out.....

I simply can't figure out who benefits from moving my post. The ATV's were using the new trail, and life was good.

In the short-term, I removed my sign, and the my post from the roadway.

I may still go down and push the concrete out of the path.

You might be on to something there.

I have also been thinking for a while about contacting the estate to see if they will hire me to maintain it.

I'm of the opinion of it were cleaned up and kept mowed, people would be less-likely to use it as a dumping ground.

We frequently have a high fire danger around here. If all that tall dry grass caught fire it would probably burn the entire fenceline.

good chance you most likely have some sort of "noise law".

you really need to hunt down the owner of the property and get permission. to point of need be "rent the property" instead of fully buying it out if that is not an option. renting would give you domain over the area. and let ya do what ya need to do and remove the trails and be able to legally enforce things. and do what you want to do.

with all the homes in picture, their might also be some sort of Home association doing. or city doing. that might help.

I own 3 of the 21 houses that back-up to this space, and I know several of the neighbors.

For the life of me, I can't figure out who benefits from blocking that new path.

I did notice a LOT of Colt 45 bottles scattered around when I was creating the new path.

Seemed like they had been there for a while, but I guess maybe I disturbed somebodies drinking spot...?

Just to be clear, I wasn't trying to close the entire space to ATV's.

I just moved one corner of the circuit about 50-yards down the road so it's not RIGHT in my backyard.

The folks on the ATV's seemed fine with it. They've been using the new path.

I basically kicked the can / moved the problem down a few houses.

I know those neighbors and they don't mind.

Around these part's, a property owner can be sued for not maintain their property, I know it's weird being from the South.

I assume that CO has a state extension office, and if they do, see if they have any information on landowner liability. NC does have such information, and to minimize land owner liability, posting the property was recommended. If someone got hurt on the vacant land, they might be able to sue the landowner for damage. There have been reports on TBN about this happening.
