I've tried...I know that I should stay out of it ...But at the risk of ruffling a few feathers, I respectifully request a futher comment on this subject.

Now lets see. Your "Inconsiderate neighbor" is planning to build a large garage with a appartment on his property, and it may require a septic system. He also has a radio tower with flashing lights which shine into your bedroom at night. And you suspect he is claiming some on your property as his and you are not knowledgeable of the survey. And you have been there for 3 months. Have I got this about right?

Well, did you talk to this "inconsiderate neighbor" before you purchased the property. Did you know that it was his plans to build the garage and that it may include a septic system? Was the tower there before you bought the property, at its present height, and did it shine in your window before you bought the property? Did you do any investigation prior to buying the property. Sounds to me like you have discovered a lot of negitive things after the purchase and now choose to change or restrict the actions of this neighbor. Kinda like people who buy a house at he end of an airport runway, then complain about airplanes.

I am in a very simular situation. I have lived on my property for 10 years with no neighbors to deal with. Now the property next to me has sub-divided and I am about to get 10 new neighbors, with our property line being my existing fence. (I know my survey) We have lived in paradise for the past 10 years, without the noise dogs, kids, music and loss of privacy of having neighbors. Do you think these people are going to be considerate of my loss as they move in. I don't think so.

I have also operated a pet cemetery since 1994, which has become a significant part of my income, and some of my new neighbors will have a pet cemetery within 20ft of their back fence. I don't expect some of them my like that. I suspect some will buy their little dream home and complain about every
thing later, maybe even that my pet cemetery is hurting their property value. I'm doing everything to inform the people before they buy, because I don't believe they are responsible enough to find out on their own. They probably won't like my barn either, or several junk Willys sitting around, and maybe they won't like my little kobota running around making noise many times after dark. But I'm here, they are moving in, and yes, I will have to put up with them and they will well have to put up with me.

Yep...I guess in some peoples eyes I am becoming an "Inconsiderate Neighbor". But, for my point of view, consideration is a two way street.

I appoligize for rambling, but this is kinda a hot subject for me right now.

Rick; A few years ago, a builder built a large community in VA next to an airport (Dulles International). People bought the houses, moved in, and then proceeded to complain to the FAA about the noise level. The airport has been there since 1962! The thing is big, you can't possible miss it! I remember one homeowner being interviewed on a news station saying yeah, he knew it was there, but didn't think planes were so loud /w3tcompact/icons/crazy.gif.

Good points on folks trying to change things when they move-in, Rick. Looks like you're going beyond your responsibilities in your case--anyone taking issue thereafter has only themselves to blame (and certainly cannot label you inconsiderate). Keep in mind you will have the law on your side if one of the new neighbors tries to infringe on your rights. I think this is the key issue in Rhody's case too: The stuff he mentions (sans the tower if it is allowed under ordinance) are not reasonable expectations of use based on law. One has to be able to expect that sanitation regulations and basic boundary/ownership rights will be adhered to and respected. He has every right to demand they are enforced--and I certainly would for health, safety and financial security. Other than that, it is the responsibility of the buyer to understand what is allowed in their zoning district and decide if they can live with it if it ever came to pass. As you said, research it--usually just a short trip to the municipalities building/zoning dept. and county health dept... Unfortunately this is something the vast majority of (sub)urbanites are ignorant of when the move to the 'country'.

I ran into a little of this too. Two years ago the cell phone company came to me and wanted to build a tower on my property. They would pay me $25,000 for a 1/4 acre of ground up front to lease. $2000 a month rent after that. They do all the maintenance on the road and the lot. I talked to the guys around me and only one had a problem with it. I wasn't going to do it then because I didn't want any upset neighbors. Well it came time to do it or not. I told them I didn't think I could. They asked why and I told them I had neighbor that didn't want me to do it. They asked who it was. Then they told me that the guy that didn't want me to do it was calling them everyday offering them to do it on his land if I didn't do it! I signed the contract that day. Anyway the point is that you have to be careful on the neighbor thing both ways. It's surely a give and take both ways.

Cell company here was similar...

Usage of 1 acre @ $1200 mo. lease, and entire property taxes paid annually for 25 years.

All I have to say is I need a cell tower on our land. Shoot they can lease all our land for that kind of dough. Just wonder what kind of energy is being transferred there though. Don't think I would mind though. Anyway sorta thinking out loud here.

They started out here at that and then when I said no they raised it to the $2k. I really wasn't trying to hold them up I just didn't want any upset neighbors. I guess when they put them up they are very specific about where they have to go to overlap their other tower's coverage.

Our cell company offered $650/mth, no up front payment. I was all for it, but the town decided that "all" those towers were an eye-sore and made it too difficult for the company to follow through /w3tcompact/icons/frown.gif.

If you are traveling through NY in the Adirondack Mountain area, you can forget bringing your cell phone. It has been designated "forever wild" and no cell towers are allowed to be put up at all (except in a couple small towns). Looking at cell phone options, the companies make it clear to you you will not get coverage in approx 1/3 of the state due to this. Why is it the "gov't" feels they can do better at land managment then the people who depend on it for a living? There are numerous farmers up here who have lost some of their best crop producing land because it was redesignated "lowland"... required to let it go back to "natural" state and now it is useless swamp... there is always a low percentage of people in any profession who abuse their responsibilities... but I would think land conservation is in the best interest to farmers and we are at the point where government intervention has gone too far. Wow... I've gotten way off the topic... sorry for the ramblings.
